GO's Commitment to Privacy

GO deems it important to protect the right to privacy of its subscribers ("Subscriber/s") and any visitor to the GO website and the GO On-Line Phone Directory ("User/s").

To better protect such right to privacy, GO is providing this Privacy Policy, explaining its online information practices and the choices that Subscribers and Users of the GO website and the website of the GO On-Line Phone Directory (together hereinafter referred to as "the Site") can make about the way in which their information is collected and used.

This Privacy Policy is easily accessible via a link at the bottom of the Site's home page and at every point where personally identifiable information may be requested on the Site.

1. REGISTRATION DATA ON THE GO WEBSITE

1.1 Processing of Registration Data


GO does not require Users to register their details prior to carrying out a simple search of the GO On-Line Phone Directory. Users may however be required to submit Registration Data in order to receive certain information and make use of particular services offered by GO on the GO website. For example, Users are currently required to provide Registration Data should they wish to receive news of updates to the Site.

To the extent that any of the details the User gives to register, together with such information as may be subsequently supplied by him in any manner, whether orally or in writing or in electronic form, constitutes personal data within the meaning of the Data Protection Act, the User, by submitting the Registration Form, is giving his consent to the processing of such data for the following purposes, namely for GO to provide its products and services, for assessment and analysis (including credit and/or behaviour scoring, market and product analysis), and to develop and improve GO's products and services. Furthermore, the User will be giving his consent to the disclosure of information to, and to the exchange thereof with, all employees of GO and its subsidiaries, associates, agents, other telecommunications operators and other carefully selected organisations and companies.

GO reserves the right to use Registration Data to send information about GO plc., the Site, GO products and services and other topics in which the User indicates an interest when submitting his Registration Data.

GO may also use and process the personal data of its Registered Users for purposes concerning direct marketing, such as to inform the Registered User, by mail or electronically or otherwise, about other products and services supplied by GO, its subsidiaries, associates, agents, other telecommunications operators, or other carefully selected organisations and companies, and may also be used for research purposes.

If the Registered User wishes to oppose the processing of his personal data for purposes concerning direct marketing, the Registered User should login using his username and password via the "login" link located at the top right of the page, and then click on "Update Profile" and change his option regarding the use of his personal data for direct marketing from "Yes" to "No", or alternatively, remove his user details from the GO Website by clicking on the "Unregister" link.


1.2 Registered Users' Right to Access Registration Data

Registered Users are informed that they may access and review or change their Registration Data at any time by logging in using the link at the top right of the home page and clicking "Update Profile".

A Registered User can change his preferences of his subscription by logging in using his username and password via the "login" link located at the top right of the page and then click on the "Update Profile" link. When he is within the "Update Profile" link, he can change his preferences of his subscription by using the "subscribe" link or if he wishes to unsubscribe click on the "unsubscribe link". These links are at the top right of the page.

Moreover, a Registered User can unregister by clicking on the "Unregister" link.


1.3 Disclaimer

GO uses all reasonable efforts to safeguard the confidentiality of the Registration Data. However by their very nature, transmissions made by means of the Internet cannot be made absolutely secure.

GO will not be held liable for the disclosure of Registration Data due to errors in transmission or unauthorised acts of third parties.




2. SUBSCRIBER DATA


2.1 Source of Subscriber Data in the GO On-Line Phone Directory

Subscriber data consist of the Subscriber's name, profession/qualifications/trade, surname, address and telephone number. GO has obtained the Subscriber Data from the Subscribers themselves. This Subscriber Data is the same data that appears in GO's printed directory, but up-dated up to the date indicated in the GO On-Line Phone Directory.


2.2 Searching the GO On-Line Phone Directory - Reverse and Multiple Search Criteria

The GO On-Line Phone Directory makes use of various functions that allows Users to carry out searches in a number of ways.

Besides the facility of searching for a Subscriber's telephone number by entering his surname, the GO On-Line Phone Directory allows a User to enter a Subscriber's phone number in order to discover such Subscriber's identity. This method of searching is known as reverse searching.

The GO On-Line Phone Directory also enables searching by multiple criteria, which allows Users to search for a particular Subscriber's entry in the GO On-Line Phone Directory by entering any detail of the Subscriber Data relating to the particular Subscriber, such as the street in which the particular Subscriber lives.


2.3 Subscribers' Right to Access Subscriber Data

Any Subscriber may, upon proof of his identity, request accessibility to Subscriber Data relating to him.

2.4 The Right of Subscribers of Residential Telephone Numbers to Opt Out of the Reverse Searching Mechanism of the GO On-Line Phone Directory
A Subscriber of a residential telephone line has the right to request to opt out of the reverse searching mechanism of the GO On-Line Phone Directory, by dialing 21 494 847 from the same residential telephone line that he is requesting be omitted from the reverse search mechanism. When a Subscriber exercises this option, his telephone number cannot be used to generate his name and address.

If a Subscriber of a residential telephone line has requested to opt out of the reverse searching mechanism, but in the future decides to opt in again in the reverse searching mechanism, he must dial 21 494 840.

If a Subscriber of a residential telephone line has requested to opt out of the reverse searching mechanism, and later his telephone line is changed into a business one, then his data will automatically be included in the reverse searching mechanism without prior notice.

Subscribers of business telephone lines cannot request to opt out of the reverse searching mechanism of the GO On-Line Phone Directory.

Any requests to opt-out of the reverse searching mechanism will be reflected on the next monthly up-date of the GO On-Line Phone Directory.



2.5 Errors and Omissions of Subscribers' Data

GO makes every effort to ensure that all the Subscriber Data are accurate and regularly updated. However, should any Subscriber become aware of any errors or omissions in respect of his Subscriber Data, such Subscriber is kindly requested to communicate the same to GO in order that such default may be remedied, or by following the instructions on the GO On-Line Phone Directory under the heading "Incorrect Details?".

GO exonerates itself from any liability in relation to any errors or omissions that may reveal themselves in the Subscriber Data and in relation to any damage that may result from such errors or omissions. GO further exonerates itself from liability for any damage that may arise from the unauthorised acts of third parties.


3. GENERAL


3.1 Cookies


Similar to other websites, the Site may utilise a standard technology called "cookies". Cookies are small pieces of data that the Site a transfers to a User's Web browser on the User's hard drive when the User visit the Site.

Cookies enable GO to recognise Users on subsequent visits to the Site and help GO improve the services made available through its Site.

Please note however that none of the information collected by means of cookies is associated with any Subscriber or User as an individual. GO does not use the cookie technology to capture individual email addresses or any personally identifying information about its Subscribers or Users.

All the information is collected on an aggregate basis and can be used to enhance the content of the Site, rendering it as user-friendly as possible, and to continually improve the Site to better meet the needs of Subscribers and Users alike. The information so gathered through cookies may include the date and time of visits, the pages viewed, time spent on the Site and the websites visited just before and just after the Site.

However, should any User wish to reject all or certain cookies used by the Site, such User may modify his Web browser preferences to do so. By rejecting all cookies however Users will be unable to use all the services available on the Site.


3.2 Conditions of Use

Users are reminded of their obligations under Maltese law, when searching or otherwise processing any Subscriber Data accessed through the Site and of the penalties that they would be liable to incur thereunder in the event of breach thereof.
