GO Mobile's Fair Usage Policy

for Internet/email Access on Mobile

1.

Mobisle Communications Ltd.�s (GO Mobile's) Fair Usage Policy is designed to make sure your broadband service is quick and reliable whenever you use it. To ensure high quality service for users of Internet/e-mail Service ("the Service"), we ask you to use the Service fairly.

2.

You agree that you shall not use the Service including but without limitation for:

a.

Unlawful, fraudulent, criminal or otherwise illegal activities.

b.

Sending, receiving, publishing, posting, distributing, disseminating, encouraging the receipt of, uploading, downloading or using any material which is offensive, abusive, defamatory, indecent, obscene, unlawful, harassing or menacing or a breach of the copyright, trademark, intellectual property, confidence, privacy or any other rights of any person.

c.

Sending or uploading unsolicited e-mails, advertising or promotional materials, offering to sell any goods or services, or conducting or forwarding surveys, contests or chain letters except for subscribers working as a sole trader in business on their own account or those that are permitted to send marketing communications in accordance with the Privacy and Data Protection Laws and Regulations.

Modem access or hosting applications for computers

e.

Peer to peer file storing or any other automated machine-to-machine applications and Internet phone calls;

f.

Knowingly or negligently transmitting or uploading any electronic material (including, without limit, files that contain viruses, corrupted files, or any other similar software or programmes) which is known or likely to cause, interrupt, damage, destroy or limit the functionality of any computer software, hardware or telecommunications equipment owned by GO Mobile or any other Internet user or person

g.

Activities that invade another's privacy, cause annoyance, inconvenience or needless anxiety to any person

h.

Activities that are in breach of any other third party's rights, including downloading, installation or distribution of pirated software or other inappropriately licensed software, deletion of any author attributions, legal notices or proprietary designations or labels in any file that is uploaded, falsification of the origin or source of any software or other material

i.

Launching "denial of service" attacks; "mail bombing" attacks; or "flooding" attacks against a host or network, Creating, transmitting, storing or publishing any virus, Trojan, corrupting programme or corrupted data

j.

Making excessive use of, or placing unusual burdens on, the network, for example by sending or receiving large volumes of email or excessively large email attachments

k.

Circumventing the user authentication or security process of a host or network

l.

Adversely affecting GO Mobile's ability to provide, complete or maintain the level or quality of its network or other services, or to cause loss or damage to GO Mobile such as using the Services for commercial purposes or reselling the Services.

3.

Responsibility

a.

You are responsible for ensuring that any member ID and/or password selected by you remain confidential so that any unauthorised person cannot use the network. The member ID and/or password referred to include, but are not limited to, those controlling access to (a) any computer/mobile hardware systems or networks; (b) any computer software or applications; or (c) any other services accessed by you in the use of either of the above.

b.

You shall not disclose any member ID or password to any third party, or use the same for any purpose connected with the improper use of the network including accessing or attempting to access other parts of the services for which you do not have access rights.

c.

You are responsible for taking all reasonable steps necessary to prevent a third party obtaining access to the network. You must immediately advise us if you become aware of any violation or suspected violation of these Security provisions.

d.

You are responsible for all uses made of the services through your account (whether authorised or unauthorised) and for any breach of this Policy whether an unacceptable use occurs or is attempted, whether you knew or should have known about it, whether or not you carried out or attempted the unacceptable use alone, contributed to or acted with others or allowed any unacceptable use to occur by omission.

e.

You agree that GO Mobileq are not responsible for any of your activities in using the network. Although the Internet is designed to appeal to a broad audience, it's your responsibility to determine whether any of the content accessed is appropriate for children or others in your household or office to view or use.

f.

If you are in breach of any of the prohibited use specified above, GO has the right to forthwith suspend / terminate the Service without notice. Also, without prejudice to the policy, GO has the right to charge you for breach of the prohibited or excessive use at GO's prevailing rate for such data usage.

g.

GO Mobile will determine the most appropriate means of providing the Service including the selected browsers, the selected client browser, technology and route of using the Service and may vary any of the means of using the Service at any time given 30 days' prior notice. Should you not accept such modification you have the right to withdraw from the service without any penalty.

h.

GO Mobile is not responsible for the content and services of external websites. Service standards in external sites may vary according to their server capacity and bandwidths and, as with all Internet services, are provided on a best effort basis. We advise you to exercise due care when navigating the World Wide Web.

i.

GO Mobile reserves the right to change the terms and conditions of this Usage Policy. Please check the most updated version from time to time.

4.

Internet Browsing Plan

If your usage in Internet Browsing Plan (i.e. browsing on a native browser on selected mobile phone models) is in breach of any of the prohibited use specified above, GO will ask you to stop the activity or reduce the usage. If you fail to do so GO has the right to forthwith suspend / terminate the Service including Internet Browsing Plan. Also GO has the right to charge you for breach of the prohibited use at GO's prevailing rate for such data usage. - Policy Date 17/07/07
