Non-DDM charge removal as from 1st December 2015

As from 1st December 2015, any charges found in all the tariffs below related to non-DDM (Direct Debit mandate) payments have been removed.

1. The Consumer Limitless Flex tariff (‘the tariff ‘) is a plan operated by MobIsle Communications Ltd. (‘ GO ‘). Access to the benefits of this tariff and the services available through it are subject to the following Terms and Conditions. By subscribing to this tariff, the customer is hereby irrevocably agreeing to and warrants to be bound by all these Terms and Conditions, without modification. If the customer does not agree to these Terms and Conditions, s/he should refrain from applying for and make use of the tariff.

2. The tariff is available for all new and existing GO Customers. Subscription to the tariff is subject to the signing and entering into a contractual obligation.

3. The tariff shall become effective as from 1st December 2015.

4. Customers subscribing to this tariff plan shall be required to pay the monthly fee of €20.

5. Customers subscribed to this tariff may also form part of GO’s Home Pack Mobile Community.

6. Customers subscribing to this tariff shall benefit from the following recurring monthly bundles:

7. Calls made towards any local fixed number and other local mobile numbers, will be charged €0.25 on a per minute basis.

8. Any local SMS usage towards any local network will be charged €0.05 per SMS.

9. Any Mobile Internet usage over and above the monthly recurring bundle, as per Clause 6(b) above, will be charged €0.10 per MB on a per MB basis and for each mobile internet session done.

10. If a customer has a combination of purchased mobile data bundles and a free mobile data bundle obtained through a GO promotional offer, and the data bundle included in this plan as per clasue 6(b) above, the free mobile data bundle and/or the data bundle included in You plan, in this order, will be consumed first.

11. Calls made and SMSes sent towards any International destinations will be charged the normal International rates. Visit the International Dialling Rates section on GO website

12. Customers may at any time check the remaining balance of their mobile internet bundle as per Clause 6(b) above, by sending a blank SMS to 16415 for free. When querying the balance of the recurring monthly bundle the customer will receive an SMS indicating the number of remaining KBs in the mobile internet bundle.

13. Customers subscribing to this tariff plan shall be required to keep the service for a minimum of three (3) months. Should the Customer opt to terminate this tariff prior to the lapse of the three (3) month period, the Customer shall be charged for the remaining months’ monthly fees pro-rata.

14. The Customer may also choose to sign a one (1) year or a two (2) year Agreement (‘the Agreement ‘) with GO for the granting of discount on a phone against the purchase of a mobile phone from one of GO’s retail outlets or authorised dealers. The amount to be granted as discount on phone is as specified in the phones section on GO website.

Customers signing an Agreement are:

(a) Regulated by these Terms & Conditions together with the conditions of the Agreement for a period of one (1) or two (2) years from the date of signature of the GO ‘Agreement of Granting of free Gift ‘ (GO Service Order Form);

(b) Bound to remain subscribed to the chosen tariff for one (1) or two (2) consecutive years;

(c) Liable to reimburse GO the fees as outlined in the Agreement if they wish to terminate their subscription to these tariffs prior to the lapse of one (1) or two (2) years from the date of signing the Agreement;

(d) Liable to reimburse GO the fees as outlined in the Agreement if they wish to upgrade or downgrade from any one of these tariffs to a different access fee than the one applicable at the time of signing of the Agreement. A new Agreement must then be signed if so desired by the Customer and the applicable discount given according to the new tariff Level.

15. E-billing is the default method used for billing Customers. In cases where the Customer prefers to opt for a printed bill sent by post, the Customer is required to pay an additional €2 monthly charge. No itemisation is available with this tariff, irrespective of the billing option selected. E-billing is accessible through the Customer’s My GO account. Only one account number can be linked to a My GO username.

16. The maximum call duration towards any number is sixty (60) minutes. Calls will be automatically terminated when the sixty (60) minutes have lapsed.

17. Once the prepaid credit is used up, Customers can top up using the prepaid top up options. Charges as specified in the Limitless Flex tariff Plan Guide apply.

18. Customers can check their prepaid balances using the normal Pay As You GO methods.

19. Should any Customer subscribed to this tariff wish to terminate or migrate this subscription to a Pay As You GO tariff plan GO reserves the right to charge the Customer the applicable migration charge which could be in addition to the penalty fees the same Customer is liable to pay if s/he is benefit ting from a discounted device or other incentive given as part of a term agreement.

20. All prices quoted in the tariff Plan Guide are inclusive of VAT but exclusive of Excise Tax, unless otherwise stated.

21. To use the connection abroad, the customer needs to have credit in the account. The roaming rates as specified in GO’s website apply.

22. The below charges will apply in conjunction with Clauses 4 and 14 above where applicable:

23. Video calls made towards other local mobile networks are charged €0.51 on a per minute basis.

24.  GO reserves the right to enforce at any time and at its discretion;

(a) That subscriptions to this tariff plan are solely based on the agreement between GO and the customer that payment for use of the services provided is done only through Direct Debit and/or Credit Card;

(b) That subscriptions to any GO service, including this tariff, are allowed only on the basis that the first access fee/monthly charge is paid in advance;

(c) Customers who do not have a positive credit profile cannot subscribe to this service. Customers who do not have a positive payment history with GO are required to provide a guarantee through a valid credit card.

26. GO reserves the right to stop, suspend, amend or otherwise alter these tariffs, the applicable charges and any benefits derived through them, as well as these Terms and Conditions, in accordance with the applicable law.

A.    Your Agreement

1.    These terms and conditions form an integral part of Your Agreement for the provision of the Service with Us, together with the following terms and conditions (together with any other documents referred therein), where applicable:

B.    The Tariff

1.    The LimitlessFlex Lite Tariff Plan (the ‘Tariff’) is a Pay Monthly mobile service provided by Us. You subscribe to this Tariff by signing an Agreement with Us.

2.      This Tariff is regulated by these terms and conditions. By subscribing to this Tariff You are agreeing to all of the terms and conditions which constitute an integral part of the Agreement. If You do not agree to any of the applicable terms and conditions, You should not subscribe to this Tariff.

3.    This Tariff became effective as from 17th November 2015.

4.    The Tariff consists of the following:

C.    Explanation of Charges & Discounts

1.    Unless otherwise stated, the charges quoted in this Tariff are inclusive of VAT and exclusive of Excise Tax, except for the charge quoted in clause B.4.k which is the full amount chargeable once customer collects the itemisation.

2.    The monthly discount specified in clause B.4.b, is inclusive of VAT and exclusive of Excise Tax.

3.    Monthly Fee:

a.    The monthly fee is paid in advance. For the first month, it will be charged on a pro-rata basis and included in the following month’s bill.

b.    The monthly discount specified in clause B.4.b is inclusive of VAT and Excise Tax, and applies if You are subscribed to an activated Home Pack or an activated Duo Pack-Phone & Internet Bundled Plan (hereinafter referred to as the ‘Bundled Plan’), subject that:

i.    The Bundled Plan and the mobile service subscribed to the Tariff are both registered in Your name;

ii.    The Bundled Plan and the Tariff are added to the same account and one (1) bill is issued for both;

iii.    If for any reason You are no longer subscribed to the one of Bundled Plans specified in Clause C.3.b above, You will no longer benefit from the monthly discount stated in clause B.4.b and the monthly fee stated in clause B.4.a will apply instead;

iv.    You accept that the Bundled Plan’s terms and conditions form an integral part of Your Agreement with Us in connection with the Tariff.

c.    The Monthly discount specified in Clause B.4.b applies also if You join a Home Pack Mobile Community when You are subscribed to this Tariff. This is subject to the following:

i.    Should the Home Pack community already be full, You shall not be accepted in the Home Pack community and informed accordingly via a return SMS notification. This will imply that You will not benefit from the monthly discount specified in Clause B.4.b. unless one of the current members is removed and Your mobile number is successfully added instead;

ii.    Once the request to join a Home Pack mobile community is successful, the Monthly discount specified in Clause B.4.b will apply on a monthly basis, for as long as You remain part of a Home Pack community;

iii.    Should the Home Pack community be terminated for any reason, the Monthly discount specified in Clause B.4.b will be applied for the last time on a pro-rata basis for that month during which the termination takes place. You will be informed accordingly via an SMS notification, that the Home Pack mobile community has been terminated;

iv.    Should Your number be removed from the Home Pack Community, You shall no longer be eligible to benefit from the Monthly discount specified in Clause B.4.b in the following months, and the Monthly discount specified in Clause B.4.b will apply on a pro-rata basis for that particular month. You will be informed accordingly via an SMS notification that Your number has been removed.

d.    For more information about the benefits, the set-up and management of the Home Pack Mobile Community You are to refer to Your Bundled Plan Terms and Conditions as per Clause A.1.c above and/or by accessing here: https://www.go.com.mt/homepackcommunitytc.

4.      You will not be entitled to benefit from the Monthly discount specified in Clause B.4.b twice in any one-month as a result of satisfying both conditions in Clauses C.3.b and C.3.c at the same time.

5.    Monthly Bundles:

a.      For the first month, the bundles specified in clauses B.4.d and B.4.e will be allocated on a pro-rata basis.

b.      At the start of the month, the bundles specified in clauses B.4.c and B.4.d are reset and any unutilised balances in the previous month’s bundles are lost.

c.      You may query the remaining balance in Your monthly bundles specified in clauses B.4.c and B.4.d by sending a blank SMS to 16415 free of charge. You will receive the information through an SMS.

d.      The monthly credit specified in clause B.4.e is a pre-paid balance. You may top it up or query the remaining balance using the normal Pay As You GO methods.

e.      The maximum credit that You may have in Your pre-paid account is €280.00. If You have reached or exceeded this credit limit, further top-ups to Your account will not be allowed until such time as the balance is reduced to below this amount.

f.      Any remaining credit from the monthly credit specified in clause B.4.e will not be lost at the end of the month. Subject to clause C.5.e above, the new month’s credit will be added to the remaining balance, which will include any other top-ups You may have affected.

g.      The maximum duration of any call is sixty (60) minutes. Calls will be automatically disconnected when this limit is reached.

h.      Any activity towards premium-rated or other special numbers will be deducted from Your pre-paid balance at the commercially applicable rates.

i.     All International Activity and Roaming is charged at the applicable international and roaming rates as published on Our website.  The cost of these activities will be deducted from Your pre-paid credit.

6.    Other Charges:

a.    This Tariff is by default an e-billing tariff. This means that You will receive Your bill through electronic means by using Our e-billing functionality available through Our Website. You agree to register for this functionality and to supply Us with a valid e-mail address where We may notify You when Your bill is available as well as send You other relevant information.

7.    Other Tariff Information:

a.    Further to clause C.3.c above, You can join a Home Pack Mobile Community when You are subscribed to this Tariff.

b.    An itemised bill will not be provided with the Tariff. However, if You require a more detailed statement, We will be able to provide it to You, subject to applicable law and regulation and where applicable at the charge quoted in clause B.4.k above.

 

D.    Minimum Term

1.    This Tariff has a minimum term of three (3) months.

2.   If You terminate during the minimum term, You will be billed an early termination fee in the form of the equivalent of three (3) months’ Standard Monthly Fee or pro-rata part thereof. This applies also if You downgrade Your Service before this minimum term expires.

3.    Following the expiry of the minimum term, unless You otherwise notify Us in writing, You shall remain subscribed to the Tariff.

 

E.    Other Important Terms and Conditions

1.    We reserve the right to accept subscriptions to this Tariff Plan only if the payment method selected is by Direct Debit.

2.    If You merge different accounts under Your name, only one payment method and billing instructions will apply.

3.    You hereby authorise Us to carry out any necessary verifications for the purposes of ensuring compliance with these conditions, however, it shall remain Your obligation to duly notify Us of any such circumstance and of any changes thereto.

4.    In the event that You benefit from the Tariff beyond such time when You were entitled to do so, You hereby irrevocably constitute Yourself as Our certain, liquid, and true debtor, and warrant and bind yourself to refund US any and all amounts wrongly benefited from and/or any penalties, charges, fees, expenses and interests due.

F.    Other Special Terms and Conditions

1.    If You subscribe to the Tariff by 28th February 2017 You will benefit from one (1) month free on the Discount Monthly Fee in clause B.4.b. As from 1st March 2017, the discount monthly fee shall be as stipulated in B.4.b.e reserve the right to accept subscriptions to this Tariff Plan only if the payment method selected is by Direct Debit.

 

On the Move 20GB

 1.       The On The Move 20GB tariff (‘the tariff’) is a plan operated by MobIsle Communications Ltd. (‘GO’). Without prejudice to Clause 19, access to the benefits of this tariff and the services available through it are subject to the following Terms and Conditions. By subscribing to this tariff, the customer is hereby irrevocably agreeing to and warrants to be bound by all these Terms and Conditions, without modification. If the customer does not agree to these Terms and Conditions, s/he should refrain from applying for and making use of the tariff.

2.       Subscription to the tariff is subject to the signing and entering into a contractual obligation.

3.       The tariff shall become effective as from 24th March 2015 until 1st December 2015.

4.       Customers subscribing to this tariff plan shall be required to pay the monthly fee of €25 through a direct debit mandate with a reputable bank.  Should the customer be unable or unwilling to pay through a direct debit mandate with a reputable bank, the monthly fee shall be of €27.

5.       Customers subscribing to this tariff shall benefit from the following recurring monthly bundle:

6.       The twenty (20) GB local Mobile Internet bundle as indicated in Clause 5 above is consumed on a per KB basis.

7.       Any Mobile Internet usage over and above the monthly recurring bundle, as per Clause 5 above, will be charged at €0.10 per MB or part thereof for each and every mobile internet session.

8.       Customers may at any time check the remaining balance of their recurring mobile internet monthly bundles, by sending a blank SMS to 16415. This service is free of charge.

9.       When querying the balance of the recurring monthly bundles as per Clause 8 above, the customer will receive an SMS indicating the number of remaining KBs in the mobile internet bundle.

10.     Customers subscribing to this tariff plan shall be required to keep the service for a minimum of three (3) months. Should the customer opt to terminate this tariff prior to the lapse of the three (3) month period, the Customer warrants and binds himself to pay to GO the monthly fees on a pro-rata basis for the remaining period of up to three (3) months.

11.      The Customer may also choose to sign a two (2) year Agreement (‘the Agreement’) with GO for the granting of discount on a device against the purchase of a device phone from one of GO’s retail outlets or authorised dealers. The amount to be granted as discount on device is as specified in the phones section on www.go.com.mt. Customers signing an Agreement are:

a.    Regulated by these Terms & Conditions together with the conditions of the Agreement for a period of two (2) years from the date of signature of the GO ‘Agreement of Granting of free Gift’ (GO Service Order Form);

b.    Bound to remain subscribed to the chosen Tariff for two (2) consecutive years;

c.    Liable to reimburse GO the fees as outlined in the Agreement if they wish to terminate their subscription to these tariffs prior to the lapse of two (2) years from the date of signing the Agreement;

d.    Liable to reimburse GO the fees as outlined in the Agreement if they wish to upgrade or downgrade from any one of these tariffs to a different access fee than the one applicable at the time of signing of the Agreement. A new Agreement must then be signed if so desired by the Customer and the applicable discount given according to the new Tariff level.

 

12.     Should any Customer subscribed to this tariff, wish to terminate this subscription or downgrade to a Pay As You GO tariff plan – GOreserves the right to charge the Customer the applicable charges specified below which could be in addition to the minimum term as specified in Clause 10 and the fees the same Customer is liable to pay if s/he is benefitting from a discounted device or other incentive given as part of a term agreement, in conjunction with Clause 11 and its sub-clauses.

13.     The roaming rates for Pay Monthly plans are those specified on GO’s website.

14.     E-Billing is the default method for billing purposes on this tariff plan. In cases where the customer prefers to opt for a printed bill sent by post, the Customer will be charged an additional €2 monthly. In cases where the customer prefers to opt for the E-billing method, customers will be required to supply GO with a valid email address upon which notifications will be sent informing the Customer when bills are issued on MyGO and other information.

15.     Itemised bills will be provided upon customer’s confirmation only if the customer had the itemisation option activated for the months in question. GO reserves the right to charge for a printed itemised bill.

16.     The below charges will apply in conjunction with Clauses 10 and 11 above where applicable :

General GO Clauses

18.     Customers who do not have a positive credit profile cannot subscribe to this tariff.

19.     In addition to these Terms and Conditions, the tariff and the use thereof are subject to the On The Move Data Plans General Terms and Conditions, as well as any applicable terms and conditions regulating the service, inter alia including the General Terms and Condition as well as any product specific Terms and Conditions. For ease of reference the applicable Terms and Conditions can be accessed on GO’s website on www.go.com.mt or from any GO outlet.

20.    In case of any add-ons or incentives, howsoever named, the relative add-on or incentive Terms and Conditions also apply. For ease of reference the applicable Terms and Conditions can be accessed on GO’s website on www.go.com.mt or from any GO outlet.

21.     GO reserves the right to stop, suspend, amend or otherwise alter the tariff, the applicable charges and any benefits derived through them, as well as these Terms and Conditions, in accordance with applicable law.

22.    GO takes privacy seriously and is committed to managing personal data transparently and fairly. The customer acknowledges and agrees that GO will process and retain his personal data, traffic data and other related data (hereinafter referred to as the ‘Subscriber’s Data’) in line with any applicable data processing and/or retention obligations.

23.    The customer also agrees and consents that the Subscriber’s Data relating to his use of the Service, including payments or lack thereof, will be retained and processed in line with the applicable data protection and retention legislation and that GO may disclose any of this:

a.    among the companies forming part of the GO group, inter alia including its parent and/or affiliated companies;

b.    its sub-contractors and/or agents;

c.    between GO and other third parties including other authorised electronic communications service providers and operators, Content providers, market research operators, and credit-rating agencies.  The customer acknowledges that such sharing of Subscriber’s Data is necessary for the purpose of providing better value and services as well as for fraud prevention, debts and credit referencing and to protect the legitimate interest of GO, its parent and/or affiliated companies and of other electronic communications operators and third parties. GOcommits to preserve all customer’s rights as data subject at all times;

d.    if required to do so by law or in the good faith belief that any such preservation or disclosure is reasonably necessary to comply with legal process, enforce the terms of the agreement, respond to claims that any use of the services violates the rights of third-parties, or otherwise to protect the rights, property or personal safety of GO, its directors, officials, employees, users, agents and/or the general public.

 

24.    The customer shall have the right to require upon due verification, access to his personal data as well as the right to rectify or, in appropriate circumstances, erase any inaccurate, incomplete or immaterial personal data processed and/or retained by GO.  Should the customer wish to exercise this right, customer must so inform GO in writing.

25.    GO undertakes to ensure that all companies within the GO Group as well as any and all third parties to whom the Subscriber’s Data is disclosed will only process the Subscriber’s Data in accordance with GO’s instructions and on GO’s behalf, and may further only use such data to the extent to which GO is itself entitled. All such companies and third parties will further be required by GO to meet the requirements of data protection and retention legislation to keep the information secure.

26.    Subject to applicable law, GO may, for accurately carrying out and confirming the customer’s instructions, for training purposes and in order to improve the quality of GO’s customer services, monitor and/or record calls made to GO. Any such recordings shall remain GO’s sole and exclusive property.

27.     The customer acknowledges and agrees that GO may further process the Subscriber Data for direct marketing purposes, that is to inform the Subscriber by mail, telephone, automatic calling machines, fax, e-mail, short messaging service (sms), or other electronic means, about products, services, packages, offers, competitions and/or any other commercial opportunity or event provided by GO or by selected third parties.

28.    Should the customer not wish GO to process the Subscriber Data for direct marketing purposes, customer may so inform GO in writing.

29.    It shall at all times remain the customer’s responsibility to inform GO of any changes occurring in the Subscriber Data provided in order that GO may be able to take all reasonable measures to keep its records in his regard correct and up-to-date.

30.    Customer acknowledges that in the case of traffic and billing data of paid and uncontested bills information shall not be held for more than one year (the term) after the bill due is paid and settled in full. You agree that any action for contesting the bill will be solely and exclusively available during this term.

C.     Explanation of Charges

1.      Unless otherwise stated:

a.      All charges quoted in this Tariff Plan are inclusive of VAT and exclusive of Excise Tax

b.      All charges applicable and reference to EU (Zone 1) in this document applies:

i.    To the list of countries in Zone 1 in Our roaming service information in our website

ii.    Also to EEA countries.

c.      , all charges quoted in this Tariff Plan are inclusive of VAT and exclusive of Excise Tax.

2.      Monthly Fee:

a.      The monthly fee is paid in advance. For the first month, it will be charged on a pro-rata basis and included in the following month’s bill.

b.      You can join a Home Pack Mobile Community when You are subscribed to this Tariff. If You join a Home Pack Mobile Community, You will be entitled to the monthly discount stated in clause B.4.b against Your standard monthly fee.

3.      Monthly Bundles:

a.      For the first month, all bundles will be allocated on a pro-rata basis.

b.      At the start of the month, all monthly bundles are reset and any remaining balance in the previous month’s bundles is lost.

c.      You may query the remaining balance in Your calls and data bundles as applicable, by sending a blank SMS to 16415 free of charge. You will receive the information through an SMS.

d.      The calls stated in clauses B.4.e, B.4.h and B.4.k are consumed/charged on a per minute basis.

e.      The maximum duration of any call whilst in Malta is sixty (60) minutes. Calls will be automatically disconnected when this limit is reached.

f.      If You keep on using Your mobile data beyond the bundle specified in clause B.4.m, any local and EU Zone 1 roaming usage will be charged on a per 100MB basis as per Clause B.4.m. Your usage as stated in clause B.4.m will continue to recur until the end of the month or until you reach €50 worth of data usage, whichever comes first. Any remaining balance from the last 100MB will be lost at the start of the following month.


g.      Any activity made towards premium-rated or other special numbers will not be deducted from the bundles specified in clause B.4. These will be charged separately and will be included in Your bill.

h.      Unless otherwise stated, all International Activity and Roaming, especially Maritime and Inflight Roaming, is charged at the international rates and roaming rates found on Our website. These will be charged separately and will be included in Your bill.

i.       Any roaming data usage in EU Zone 1 over and above any bundle included in these Tariff Plans as specified in B.4 above, has an automatic €50 cap. Upon connecting to a roaming data service and upon reaching €40 of roaming data usage, You will be notified via SMS that your mobile data will be stopped upon reaching €50. You will also be informed that you can Opt-out of this capping by sending OPTOUT to 50700295. This will set all your future roaming data usage as unlimited and without capping and you will be charged the standard data pay per use rate in B.4.m above. To make sure that future roaming data usage would be capped again at €50 you should send OPTIN to 50700295 at Your discretion.

j.       Any roaming data pay-per-use usage in any other country worldwide other than Zone 1, has an automatic €50 cap. Upon connecting to a roaming data service and upon reaching €40 of roaming data usage, You will be notified via SMS that your mobile data will be stopped upon reaching €50. You will also be informed that you can Opt-out of this capping by sending OPTOUT to 50700295. This will set all your future roaming data usage as unlimited and without capping. To make sure that future roaming data usage would be capped again at €50 you should send OPTIN to 50700295 at Your discretion.

k.      4G data service whilst roaming is offered in particular countries with particular service providers as indicated in the roaming information of Our website.

l.       EU Zone 1 Roaming Bundle:

i.        The EU Zone 1 Roaming Bundle applies while You are roaming in the EU (Zone 1). The list of countries included in Zone 1 is found in the roaming service information on Our website.

ii.        The calls specified in clause B.4.j are charged on a per minute basis.

iii.        The voice bundle applies when You call a Maltese or EU Zone 1 number while roaming in one of the countries listed in Zone 1.

iv.        The SMS bundle may be used for sending SMS to any number worldwide while roaming in Zone 1.

v.        You will receive an SMS notification when You have used up Your calls, SMS and data bundles for EU Zone 1.


                             vi.        Since We rely on Our roaming partners to provide Us with roaming information, there may be some delay in receiving information related to the usage You made while roaming. This means that the usage may not be deducted from the EU Roaming Bundle applicable to the month when You were abroad. In these cases, We will deduct the applicable usage from the following month’s EU Roaming Bundle.

vii.        Once You consume the usage included within Your EU Roaming Bundle, the usage will be charged at the standard roaming rates specified on Our website.

viii.        The standard roaming rates apply for roaming outside the EU (Zone 1). The rates are specified in Our website.

4.      Other Charges:

a.      This Tariff is by default an e-billing tariff. This means that You will receive Your bill through electronic means. You agree to supply us with a valid e-mail address where We may notify You when Your bill is available as well as send You other relevant information.

 

D.     Minimum Term

1.      This Tariff has a minimum term of three (3) months.

2.      If You terminate the Agreement during the minimum term, You will be billed an early termination fee in the form of the three (3) months’ rental charges or pro-rata part thereof. This applies also if You downgrade Your Service before this minimum term expires.

3.      You may choose to benefit from an Agreement Benefit if You bind Yourself to remain subscribed to this Tariff for a two (2) year period. The Agreement Benefit may take the form of a discounted/free device from the selection made available by Us for this purpose at the time of Your signing the Agreement or else a monthly discount on Your bill for the duration of the Agreement Benefit time period.

4.      If You terminate the Agreement during the term of the Agreement Benefit, You will charged the penalty fees as specified in the Agreement Benefit and this Agreement.

 

E.     Other Important Terms and Conditions

1.      We reserve the right to accept subscriptions to this Tariff Plan only if the payment method selected is by Direct Debit.

2. If You are subscribed to Limitless Three, You will be eligible to a ‘Smartphone Care’ for the smartphone selected as per clause D.3 above, which entitles You to have your smartphone repaired one-time without any charge or to benefit from a one-time replacement smartphone in cases where the smartphone is declared as having had an out of warranty fault such as; damage to the screen and other faults but excluding liquid damage. For the avoidance of doubt, You are entitled to benefit from one (1) free repair or smartphone replacement for the whole duration of the agreement as specified in D.3. Theft or loss of Your smartphone is not covered as part of the Smartphone Care Pack.

3. if You are subscribed to Limitless Three, You will also be eligible to “Caller Priority”. Upon contacting the GO Customer Care Centre from the contracted mobile number, the Call will be given priority for immediate assistance.

A.     Your Agreement

1.      These terms and conditions form an integral part of Your Agreement for the provision of the Service with Us, together with the following terms (together with any other documents referred therein), where applicable:

d.      The Tariff Plan Terms and Conditions and/or Schedule of Charges

e.      The End User License Agreement (EULA)

2.      If any of these documents conflict with one another, the terms will apply in the order of precedence set out above.

3.      The Tariff applicable to Your Agreement is specified in the Application Form.  We reserve the right to stop, suspend, amend or otherwise alter this Tariff, the applicable charges and any benefits derived through it, as well as these terms and conditions, in accordance with applicable laws.

B.      The Tariff

 

1.      The Limitless One+/Two+/Three+ Tariff Plan (the ‘Tariff’) is a Pay Monthly mobile service provided by Us. You subscribe to this Tariff by signing an Agreement with Us.

2.      This Tariff is regulated by its terms and conditions. By subscribing to this Tariff You are agreeing to all of the terms and conditions found in the Agreement. If You do not agree to any of these terms, You should not subscribe to this Tariff.

3.      This Tariff became effective as from 25th May 2016.

i.    The EU Roaming Monthly Bundles apply while You are roaming in the EU (Zone 1). The list of countries included in Zone 1 is found in Our website.

ii.    The voice bundle in clause B.4.j applies when You call any Maltese (+356) or EU Zone 1 number while roaming in one of the countries listed in Zone 1. If you go beyond the bundle, any usage will first continue depleting your voice bundle from in B.4.d and any usage above this bundle will subsequently be charged at the  pay per use rates specified in B.4.o  above.

iii.    The SMS bundle in clause 4. l may be used for sending SMS to any Maltese (+356) or EU Zone 1 number while roaming in Zone 1. If you go beyond the bundle, any usage will first continue depleting your SMS bundle from in B.4.f and any usage above this bundle will subsequently be charged at the  pay per use rates specified in B.4.p  above.

iv.    Since We rely on Our roaming partners to provide Us with roaming information, there may be some delay in receiving information related to the usage You made while roaming. This means that the usage may not be deducted from the EU Roaming Bundle applicable to the month when You were abroad. In these cases, We will deduct the applicable usage from a subsequent EU Roaming Bundle.

v.    If You keep on using Your mobile data beyond the bundle specified in clause B.4.n, any usage will first continue depleting your data bundle as specified in B.4.g and any usage above this bundle will subsequently be charged at the pay per use rates specified in B.4.q above.

vi.    Once You consume the usage included within Your EU Zone 1 Roaming Bundles while roaming in the EU Zone 1, the usage will be charged at the standard local pay per use rates specified in B.4.o to B.4.q above.

vii.    The standard roaming rates apply for roaming outside the EU (Zone 1). The rates are specified in Our website.

a.      This Tariff is by default an e-billing tariff. This means that You will receive Your bill through electronic means by using Our e-billing functionality available through Our Website. You agree to register for this functionality and to supply Us with a valid e-mail address where We may notify You when Your bill is available as well as send You other relevant information.

D.     Minimum Term

 

1.      This Tariff has a minimum term of three (3) months.

2.      If You terminate the Agreement during the minimum term, or if the Agreement is terminated by Us for any reason attributable to You (including non or late payment of amounts due), You will be billed an early termination fee in the form of the three (3) months’ rental charges or pro-rata part thereof. This applies also if You downgrade Your Service before the minimum term expires.

3.      You may be entitled to benefit from an Agreement Benefit if You bind Yourself to remain subscribed to this Tariff for a two (2) year period. The Agreement Benefit may take the form of a discounted/free device from the selection made available by Us for this purpose at the time of Your signing the Agreement or else a monthly discount on Your bill for the duration of the Agreement Benefit time period.

4.      If You terminate the Agreement during the term of the Agreement Benefit, You will charged the penalty fees as specified in the Agreement Benefit and this Agreement.

 

E.     Agreement Benefit

 

1.      You have the option to benefit from an Agreement Benefit with Your Agreement when You subscribe to these tariffs, subject that You bind yourself to the Service stated in Your Agreement with Us for a period of two (2) consecutive years (the Agreement Benefit Term).

2.      There are two types of Agreement Benefits. You may choose only one (1) from the following options:

 

a.      Sim Only discount

The Agreement Benefit may take the form of a monthly discount on Your standard monthly fee, referred to as SIM only discount, for the duration of the Agreement Benefit Term, as follows:

i.    The SIM Only discounts in E.2.a above are inclusive of VAT and exclusive of Excise Tax.

ii.    If You choose to terminate or disconnect the Pay Monthly service or if the Agreement is terminated by Us for any reason attributable to You (including non or late payment of amounts due) prior to the lapse of the Agreement Benefit Term You are bound to pay GO 100% of the monthly discount assigned under this scheme for the number of months into the Term before termination/disconnection together with the termination fee. A fee related to the minimum term policy on the Limitless Pay Monthly plans may also apply as specified in D.2 above.

iii.    If You choose to terminate Your Agreement Benefit in the months of the Agreement Benefit Term indicated below You will be required to pay the remaining unpaid monthly fees applicable to Your respective tariff plan as a termination fee, as follows:

b.      Device Discount

i.    The Agreement Benefit may take the form of a discount on phone against the purchase of a mobile device from one of GO’s retail outlets or authorised dealers.

ii.    The amount to be granted as discount on phone is as specified in the phones section on Our website.

iii.    You are liable to reimburse GO the fees as outlined in the Agreement, or a pro-rata thereof according to law, if You terminate Your subscription, or if the Agreement is terminated by Us for any reason attributable to You (including non or late payment of amounts due) prior to the lapse of two (2) years from the date of signing the Agreement;

iv.    You are liable to reimburse GO the fees as outlined in the Agreement if You upgrade or downgrade from any one of these tariffs to a different access fee than the one applicable at the time of signing of the Agreement. In any such event, You need to sign a new Agreement and may be entitled to benefit from another applicable discount given according to the new Tariff level.

v.    If You are subscribed to these tariffs and You wish to terminate this subscription or downgrade to a Pay As You GO tariff plan, We reserve the right to charge You the applicable charges specified in the Agreement which could be in addition to the minimum term as specified in D above and the fees you are liable to pay if Your are benefitting from a discounted device of the Agreement Benefit.

F. Other Terms

1. If You are subscribed to Limitless Three+, You will be eligible to a ‘Smartphone Care’ for the smartphone selected as per clause E.2.b above, which entitles You to have your smartphone repaired one-time without any charge or to benefit from a one-time replacement smartphone in cases where the smartphone is declared as having had an out of warranty fault such as; damage to the screen and other faults but excluding liquid damage. For the avoidance of doubt, You are entitled to benefit from one (1) free repair or smartphone replacement for the whole duration of the agreement as specified in E.2.b. Theft or loss of Your smartphone is not covered as part of the Smartphone Care Pack.
