General
1. The Shareholders Loyalty Scheme 2017-2018 (‘the Scheme’) is operated by MobIsle Communications Ltd. (‘GO‘). Access to the benefits of the Scheme is subject to the following Terms and Conditions. By subscribing to the Scheme, the customer is hereby irrevocably agreeing to and warrants to be bound by all these Terms and Conditions. If the customer does not agree to these Terms and Conditions, s/he should refrain from applying for and making use of the Scheme.
2. Shareholders are categorised according to the amount of shares they own, these can be identified in table below;

3. The Scheme is available to all GO Silver, Gold or Platinum Shareholders (hereinafter the ‘Eligible Shareholders’) that subscribe to any of the below Mobile Pay Monthly Plans in Clause 5.
4. The Scheme shall become effective as from 5th June 2017 and shall be valid till 30th June 2018 or upon the announcement of a new scheme which will supersede the Scheme as advised in the company Annual General Meeting 2018 (hereinafter the ‘Term’). Upon the termination of the Scheme, the Eligible Shareholder shall automatically revert back to the standard monthly tariff applicable for the Mobile Pay Monthly Plans to which s/he is subscribed.
5. Eligible Shareholders subscribing to the Scheme shall benefit from a monthly discount, as indicated in the table below, depending on which Pay Monthly Plan s/he is subscribed to. These discounts may be only be availed of by Eligible Shareholders falling in any of the Shareholder categories mentioned in Clause 3 above, and are in addition to any other discounts and/or benefits to which the Eligible Shareholder may be entitled to in connection with the agreement regulating his/her subscription to the Mobile Pay Monthly Plans.

6. Eligible Shareholders acknowledge and agree that by subscribing to the Scheme any previous GO shareholder discount schemes on the mobile telephony service mentioned in the Agreement will cease with immediate effect. For the avoidance of doubt, under the Scheme, Eligible Shareholders will benefit from the applicable discount/s on the tariff only for the duration of the Scheme subject that they remain Eligible Shareholders throughout the Term.
7. Eligible Shareholders acknowledge and agree that in order to benefit from the Scheme, the Mobile Pay Monthly Plan to which the discounted tariff is to be applied must be registered in the Eligible Shareholder’s name. For the avoidance of doubt, it is hereby being clarified that Eligible Shareholders may benefit from the Scheme in connection to each and every Mobile Pay Monthly Plans registered in their name, subject that Eligible Shareholders may only be entitled to benefit from up to two (2) Mobile Pay Monthly Plan with the discounted tariff discounts, in the case of Silver and Gold Shareholder categories and up to four (4) discounts Mobile Pay Monthly Plan with the discounted tariff discounts in the case of Platinum Shareholders, at any one time.
8. GO reserves the right to verify from time to time that during the Term the Eligible Shareholder benefiting from the Scheme is still an eligible shareholder and that the Mobile Pay Monthly Plan to which the discounted tariff is being applied is registered in the Eligible Shareholder’s name. For the avoidance of doubt in the event of any movement in the number of shares the shareholder possesses below the minimum threshold eligible to benefit from the Scheme as per Clause 3 above, the shareholder hereby irrevocably acknowledges that s/he will no longer be entitled to any discounts in connection with the Scheme. The shareholder hereby assumes the responsibility of informing GO of any changes in his/her shareholding status without delay.
9. For the avoidance of doubt and further to Clause 8 above, should the shareholder no longer possess the minimum threshold eligible to benefit from the Scheme s/he will no longer receive the relevant discount on the tariff and the standard tariff plan charges including any add on charges as stipulated in the Tariff Plan guide shall be levied. Should the shareholder wish not to retain the Mobile Pay Monthly Plans, any penalty charges as stipulated in the agreement regulating the service would apply.
10. In all events where the shareholder is no longer eligible to benefit from the Scheme, the applicable charges shall apply on all services and usage as stipulated in the applicable Tariff Plan.
11. It is in the Shareholders interest and sole responsibility to apply for any Shareholder Loyalty Schemes available at any given time. Under no circumstance shall GO be held liable for any failure on the part of the shareholder to apply for any Shareholder Loyalty Schemes available at any given time or for any benefit/s lost in connection therewith.
12. In addition to these Terms and Conditions, Eligible Shareholders acknowledge and agree that the Scheme and the Mobile Pay Monthly Plans are further regulated by the applicable GO‘s General Terms and Conditions as well as the Pay Monthly Terms and Conditions. Unless otherwise stated, in the event of any conflict between the applicable terms and conditions, these Pay Monthly Terms and Conditions shall apply.
13. GO reserves the right to stop, suspend, amend or otherwise alter the Scheme and any benefits derived through it in accordance with the applicable law.
14. GO takes privacy seriously and is committed to managing personal data transparently and fairly. The Eligible Shareholder acknowledges and agrees that GO will retain his personal data, traffic data and other related data (hereinafter referred to as the ‘Subscriber’s Data’) in line with any applicable data retention obligations.
15. The Eligible Shareholder also agrees and consents that the Subscriber’s Data relating to his/her use of the Service will be retained and processed in line with the applicable data protection and retention legislation and that GO may disclose any of this:
a. among the companies forming part of the GO group, inter alia including GO p.l.c., its parent and/or affiliated companies;
b. GO group companies sub-contractors or agents;
c. between GO and other third parties including other authorised electronic communications service providers and operators, Content providers, market research operators, and credit agencies. The Eligible Shareholder acknowledges that such sharing of Subscriber’s Data is necessary for the purpose of providing better value and services in particular on the electronic communications services or other services as might be provided by GO as well as for fraud prevention, debts and credit referencing and to protect the legitimate interest of GO, its parent and/or affiliated companies and other electronic communications operators and third parties. GO commits to preserve all subscriber’s rights as data subject at all times;
d. if required to do so by law or in the good faith belief that any such preservation or disclosure is reasonably necessary to comply with legal process, enforce the terms of the agreement regulating the service, respond to claims that any use of the services violates the rights of third-parties, or otherwise to protect the rights, property or personal safety of GO, its directors, employees, users and the general public.
16. The Eligible Shareholder shall have the right to require upon due verification, access to his/her personal data as well as the right to rectify or, in appropriate circumstances, erase any inaccurate, incomplete or immaterial personal data processed by GO. Should the Eligible Shareholder wish to exercise this rights, s/he must so inform GO in writing.
17. GO undertakes to ensure that all companies within the GO Group as well as any and all third parties to whom the Subscriber’s Data is disclosed will only process the Subscriber’s Data in accordance with GO’s instructions and on GO’s behalf, and may further only use such data to the extent to which GO is itself entitled. All such companies and third parties will further be required by GO to meet the requirements of data protection legislation to keep the information secure.
18. GO undertakes It shall at all times remain the Subscriber’s responsibility to inform GO of any changes occurring in the data provided in order that GO may be able to take all reasonable measures to keep its records in his regard correct and up-to-date.
