1.1 These Terms and Conditions form the agreement between the Customer (hereinafter ‘You’ or ‘Your’), an individual purchasing an eligible product from GO and registering to enter an event related promotion associated with that purchase, offered by the GO p.l.c, (hereinafter ‘Us’ or ‘We’ or ‘Our’), with registered offices at Fra Diegu Street, Marsa MRS 1501, Malta.
2.1 To be eligible to enter this promotion, You must be over 18 years of age and be a resident of Malta. By completing a purchase and registering to take part You warrant to us that You meet the eligibility criteria, and agree to be bound by these Terms and Conditions. If We become aware at any time that You do not meet the eligibility criteria or have breached any of these Terms and Conditions, We reserve the right to void Your entitlement to any of Our promotions, at Our discretion. Your statutory rights are not affected.
2.2 To be eligible to participate in the promotion You must meet one of the following criteria:
a. You are a new customer to Home Pack Interactive,
b. You are an existing customer upgrading from Home Pack Silver Interactive to Home Pack Gold Interactive,
c. You are an existing customer upgrading from Home Pack Silver DTTV to Home Pack Silver/Gold Interactive,
d. You are an existing customer upgrading from Home Pack Gold DTTV to Home Pack Gold Interactive.
2.3 GO employees and their families cannot take part in this reward scheme.
3.1 To take part in this promotion You must make a successful purchase from Us of an eligible product by calling Freephone 80072381. The qualification period of the promotion is from the 3rd till the 17th June 2016, both days included. The logged call defines the time and date of Your purchase. Entry into the promotion will only be deemed valid once You sign Your contract for the Home Pack Interactive package.
3.2 We accept no responsibility for any incorrect or incomplete registrations. We will not be liable for technical, hardware or software failures of any kind, or lost or unavailable network connections which may limit, delay or prohibit Your ability to participate in the promotion. If We have reason to suspect that the promotion has been manipulated, altered, tampered with or abused in any way, We reserve the right to withdraw or amend the terms of the promotion, or remove, or void some entries at Our absolute discretion. If We have reason to suspect that You have been involved in any manipulation, falsification, fraudulent or illegal activity connected with the promotion, We reserve the right to disqualify You and any related entries.
4.1 In order to be eligible for the promotion, You must:
a. ‘Register’ for Home Pack Interactive as specified in the Eligibility section above and
b. ‘Claim’ a reward at the time of purchase which reward will be confirmed over the phone by Our representative.
4.2 You confirm that the personal details You provide at registration are Yours. Where We have reasonable grounds to believe that this is not the case, or that any information has been falsified, We reserve the right to void entitlement to the reward. If We consider that a registration is invalid and/or incomplete We will notify You that Your registration has been rejected – and the reasons for the rejection. Upon receipt of Your claim, We will verify whether the claim is valid and made in accordance with these Terms and Conditions. If We consider that a claim is invalid You will be notified that Your claim has been rejected and the reasons for the rejection. Our decision on validity of claims is final and no correspondence will be entered into.
4.3 Please note that claims will be disqualified if You cancel Your purchase order or if You do not install the service within 30 days from application. 4.4 We may at Our absolute discretion disqualify any registrations or claims which We feel do not comply with these terms and conditions or where any form of bad faith is suspected.
5 Reward and Pay-Out
5.1 The reward consists of six (6) months free subscription to GO Sports Premium. The reward will be tied to the winning team of the Euro 2016 football tournament. You become eligible for the reward if:
a. You have already installed Home Pack Interactive;
b. You correctly choose the winner of Euro 2016 and
c. You answer correctly to a skill based question when We contact You by phone.
5.2 This reward cannot be exchanged in value for cash and is not transferable.
5.3 In the event that You are already a customer to GO Sports You will receive a credit on account which is equivalent to the package You are subscribed too. In the event that You are not a customer to GO Sports You will not be billed for the reward.
5.4 Once the six (6) months are over,
a. if You were already a GO Sports customer You will continue to be billed for Your GO Sports service, or
b. if You were not a GO Sports customer and You do not wish to continue receiving the GO Sports service You should contact Us on Freephone 80072121 before the expiry of this term so that We will remove the GO Sports service; otherwise You will start being billed for the GO Sports service at the monthly rate.
5.5 In the event that the specified reward becomes unavailable for any reason outside of Our control, We may substitute a reward of like or equal value.
5.6 The pay-out will be rewarded upon the end of Euro 2016 and subject that the conditions set out in these terms and conditions are met.
6 Your Obligations
6.1 By participating, You grant Us exclusive permission to use Your name, character, photographs, voice and likeness in connection with this offer and waive any claims to remuneration, howsoever defined, for such use. Furthermore, if You win and accept the reward, You agree to participate in and co-operate as required with all reasonable media editorial requests relating to the reward, including but not limited to, being interviewed and photographed, filmed and/or chaperoned. You waive any claim for compensation from Us for the use of such media taken or for any time required for such participation. You must also be willing to wear any accessories as required for photographs and other media related events as required.
6.2 In the event that any of the specified teams identified as part of this offer do not win, You will not be entitled to benefit from this offer. For the avoidance of doubt, You acknowledge that if You decide to terminate the Home Pack Interactive service, the terms and conditions governing the Home Pack Interactive service, including early termination penalties, shall still apply.
7.1 We shall not be liable for any failure to fulfill this offer where such failure is caused by any circumstances beyond Our control or where bad faith is suspected. Such circumstances out of Our control shall include, but shall not be limited to, severe weather conditions, fire, flood, war, earthquakes, riots, industrial dispute, terrorism, acts of God, supervening legislation, or events which, without the fault of either party, render performance impossible or incapable of satisfactory execution. If for any reason an event associated with the promotion is suspended, terminated or delayed, We reserve the right to likewise suspend, terminate or extend the promotion. If the event is cancelled We also reserve the right to substitute with another event at Our discretion. We shall not be liable for any loss incurred as a result of any technical issue which prevents You from completing a purchase or registering for the promotion.
8 Data Protection
8.1 The Data Protection provisions in the applicable Home Pack Interactive service terms will also apply.
9.1 These terms and conditions are governed and construed according to the Laws of the Republic of Malta. Any disputes are to be submitted to the jurisdiction of the Maltese courts.
