Home Pack Terms and Conditions before 27th August 2015

Limitless Home Pack Gold Interactive

1. This Bundle Service Agreement (hereinafter referred to as “The Agreement”) is being entered into by GO p.l.c, (C22334), being the operator of the brand ‘GO’, duly authorized to act in representation of its subsidiary and affiliate companies members of the GO Group (hereinafter referred to as “We” / “Us”/ “Our”).  The Bundle (as specified in clause 2 below) is subject to the following terms and conditions (“The Bundle Service Terms and Conditions”), The Agreement entered into between Us and the Registered Residential Subscriber (hereinafter referred to as “You” / “Yourself” / “Your”) indicated therein for the provision of The Bundle, as well as the standard terms and conditions of each individual service making up The Bundle and any other applicable terms and conditions. In the event of any difference or conflict between The Bundle Service Terms and Conditions, the standard terms and conditions of each individual service making up The Bundle, and any other applicable terms and conditions, The Bundle Service Terms and Conditions shall prevail.

2. The Bundle entitles You to all of the following services at the rate of forty eight euros (€48) per month:

a. GO Gold Interactive television service.

b. GO Talk Anytime fixed phone line service and GO Talk Anytime Limitless All Local Fixed add-on bundle.

c.  GO internet, 15Mbps, subject to the speed your line can attain.

d. Up to 400 free mobile minutes  on a monthly basis, given in up to four (4) individual free minute bundles of 100 minutes each, with one (1) bundle per individual member within the Home Pack mobile community (‘’Community”) in accordance with Clause 8 below.

3. The rate of forty eight euros (€48) per month includes the access fee of one (1) television service as indicated in Clause 2(a) above. To activate GO Interactive television service on other set-top boxes within the Residential Premises, an extra monthly GO Interactive TV additional outlet fee per set-top box as per Schedule of Charges applies.

4. If You are a new television customer, The Bundle entitles You to all of the following:

a. Two (2) Free GO Interactive TV HD boxes,  in accordance with Clause 5 below.   For the avoidance of doubt should you require additional set-top boxes for additional tv outlets, the one-time charges for the set top box/es including installation shall apply as per rates stipulated in the Schedule of Charges.

b. Free standard installation of the GO Interactive television service indicated in Clause 2(a) above. For the avoidance of doubt, the free GO television installation will be provided at the Residential Premises indicated in The Agreement and on one (1) GO Interactive HD TV box. Should You be benefiting from the second free GO Interactive HD TV box, one (1) self-installation kit will be provided to You free of charge for You to install the second free GO Interactive HD TV box.

5.  If You are an existing GO television subscriber, and have already benefitted from a set-top box/CAM offer under a previous offer/s, You would be entitled to the free use of up to two (2) GO Interactive TV HD box/es upon the return of up to two (2) free DTTV set-top box/CAM when upgrading to The Bundle, and committing to all terms and conditions of The Bundle.

6. If You are a new GO fixed phone line customer, The Bundle entitles You to free installation of the GO fixed phone line service indicated in Clause 2(b) above. For the avoidance of doubt, the free GO fixed phone line installation will be provided at the Residential Premises indicated in The Agreement.

7.  If You are a new GO internet customer, The Bundle entitles You to all of the following:

a. Free installation of the GO internet service as indicated in Clause 2 (c) above.  For the avoidance of doubt, the free GO internet installation will be provided at the Residential Premises indicated in The Agreement.  Additional charges may apply for the installation of other internet services as listed in the respective Schedule of Charges.

b. The free use of a GO standard modem for the internet service indicated in Clause 2(c) above.  For the avoidance of doubt, it is being agreed that the modem is being leased free of charge, and any equipment will remain property of GO.  Additional charges may apply for other types of customer premises equipement as listed in the respective Schedule of Charges.

8. For You to benefit from the free bundle of mobile minutes as per Clause 2(d) above, You need to activate Your Community as per Clause 11 below. You may also invite up to three (3) other GO mobile numbers, in addition to the GO mobile number, to form part of the Community. The four (4) Community members can be either subscribed to any Pay As You GO mobile tariff plan as per Clause 9 below or to any of the GO mobile Pay Monthly Plans compatible with Home Pack. The latter will hereinafter be referred to as “Pay Monthly”.   For the avoidance of any doubt, every member of the Community is entitled to a maximum of one hundred (100) free minutes per month and no transfer of minutes from one member to another is allowed. For the avoidance of doubt, in the event that the maximum of one hundred (100) free minutes per monthly bundle is consumed, and the GO mobile number forming part of Your Community in the given month is changed in accordance with these terms and conditions, then the new number forming part of Your Community will not be entitled to receive the free minute bundle prior to the lapse of the month in which the free minutes were consumed by the previous GO mobile number.

9. If You are a Pay As You GO mobile customer, Your tariff plan will change to the Pay As You GO Home Pack mobile tariff plan once Your request to activate the Community is successful. If any of the other GO mobile numbers You add to Your Community further to Clause 8 above, are also Pay As You GO mobile customers, their tariff plan will also change to the Pay As You GO Home Pack mobile tariff plan once they accept to join Your Community. In the event that a member of the Community no longer remains part of Your Community, their mobile tariff plan will automatically be migrated to GO’s Pay As You GO Base plan.  You assume all responsibility to inform members of Your Community of these conditions.

10.  A Community is a group of up to four (4) Pay As You GO and/or Pay Monthly GO mobile customers as per Clauses 8 and 9 above, who can benefit from free mobile minutes by joining a Community.  Your GO mobile number or the GO mobile number nominated by Yourself to activate the Community, will be able to invite three (3) other eligible GO mobile customers as indicated in Clause 8 above, to form part of the Community. The first three Community members are added free of charge.  Any changes thereafter cost one euro sixteen cents (€1.16) per number. Without prejudice to Your and/or Our right to suspend and/or terminate this Agreement, for the avoidance of doubt, it is hereby being expressly stated and agreed that only the registered GO mobile number nominated by Yourself to activate the Community will have the right for the day to day management of and for any information associated with the Community. To be eligible to join a Community, the GO mobile numbers:

a. Must be verified by GO as registered customers on the appropriate tariff plan;

b. Can only form part of one (1) Community at any given time.

11. Your Community is formed as follows:

a. You or The Pay As You GO or Pay Monthly number nominated by Yourself activates the Community by sending an SMS to 50700280, containing The Subscription Number and the GO Talk Anytime fixed phone line number forming part of The Bundle. The format of the SMS should be as follows: 2XXXXXXX PXXXXXXXXXX, where 2XXXXXXX indicates the GO Talk Anytime fixed phone line number and PXXXXXXXXXX indicates The Subscription number. The SMS is free of charge. The Subscription number can be found on page 1 of The Bundle Service Agreement.

b. You or the nominated Pay As You GO / Pay Monthly number can invite up to three (3) other Pay As You GO and/or Pay Monthly customers to the Community by sending an SMS to 50700281 containing the mobile number being requested to be added to the Community. The first three (3) SMSes are free of charge. As per Clause 10 above any changes to these numbers can be made, at any time, at the cost of one euro sixteen cents (€1.16) per SMS.

c. The Pay As You GO and/or Pay Monthly customers eligible to join the Community will become members of the Community only once they accept Your invitation by replying to the SMS sent from GO, and the Community will be considered to be full once three (3) Pay As You GO and/or Pay Monthly customers together with Your/the nominated Pay As You GO or Pay Monthly number have joined the Community.

12. Once the Community is set up, The Bundle will entitle You to:

a. up to four hundred (400) free mobile minutes given in individual bundles of one hundred (100) minutes each in accordance with  Clause 2 (d)  and Clause 8 above and which can be used as follows:

i. on calls between the four (4) GO mobile numbers within Your Community in accordance with Clause 11 above.

ii. on calls from the four (4) GO mobile numbers towards the GO Talk Anytime fixed phone line number forming part of The Bundle.

b. Your free mobile minute bundle, as per Clause 2(d) above will be assigned on the day of successful creation of Your Community. Invited Community members will be assigned their respective free mobile minute bundle upon successful registration to Your Community. In the case of Pay As You GO mobile customers each individual bundle will be assigned in full upon joining the Community and will then be renewed each month, on the same date when the first bundle has been assigned. For customers on Pay Monthly plans, their individual free mobile minute bundle will always be assigned on the 1st of every month except for the first bundle which will be assigned on a pro-rata basis on the date when they have successfully joined the Community.

c. Any unutilised free minutes are not carried forward if not consumed within the month.

d. The free minutes cannot be transferred through Credit Transfer.

e. The free -minutes are deducted on a per 30-second basis.

f. The maximum call duration is 60 minutes and calls shall be automatically terminated when the 60 minutes have elapsed.

g. Upon consumption of each individual free mobile minute bundle, intra-community calls to each individual Community member (including calls towards the GO Talk Anytime fixed phone line number) are to be charged at the applicable rates in accordance with the customers’ Tariff Plan.  It is Your responsibility to inform the Community members of these conditions.

h. Your or the nominated Pay As You GO / Pay Monthly number can send a blank SMS to 50700284 at a charge of  €0.05 to query the Community members.

i. Members of a Community can check whether a number is part of a Community by sending a SMS quoting the number to be checked to 50700284 at a cost of €0.05.

j. Members of a Community can check the remaining balance of minutes in their respective free bundle by sending a blank SMS to 50700285 at a charge of €0.05.

k. Calls from the GO Talk Anytime fixed phone line towards the registered applicable Community’s GO mobile numbers will be charged as per the Talk Anytime rates.

l. The free minutes assigned to each individual Community member, as per Clause 2(d), can be used when making calls from Malta in line with Clause 12 (a).  For the avoidance of doubt any other calls made whilst in Malta to numbers not members in Your Community will be charged at the local call rates applicable to the customer’s mobile tariff plan. The standard charges apply when calling from abroad.  For further information regarding roaming charges, please refer to Roaming section of the GO website (www.go.com.mt).

13. A Community member is deemed to be part of Your Community until:

a. The Community member sends a blank SMS to 50700282 (free of charge) at any time to withdraw from the Community.  In cases of Pay As You GO type of subscriptions, any Community members withdrawing from the Community will have their mobile tariff plan automatically migrated to GO’s Pay As You GO Base Plan.

b. Your or the nominated Pay As You GO/ Pay Monthly number excludes a member of the Community by sending a SMS to 50700283 (cost is €0.05) containing the mobile number being requested to be withdrawn from the Community.  In cases of Pay As You GO type of subscriptions, any Community members removed from the Community will have their mobile tariff plan automatically migrated to GO’s Pay As You GO Base Plan.

c. The Agreement is terminated or not renewed, for any reason and by any Party.

14. The free minutes entitlement in line with Clause 2(d) above will no longer be available if:

a. The Agreement is terminated or not renewed, for any reason and by any Party;

b. We suspend and/or disconnect any or all of the Services making up The Bundle for any reason attributable to You;

c. You or the nominated Pay As You GO / Pay Monthly number terminates the Community;

d. You or the nominated Pay As You GO / Pay Monthly number is no longer a GO subscriber for mobile services or migrates to any other Tariff Plan not compatible with The Agreement.

15. By entering into The Agreement with Us for the provision of The Bundle, You hereby irrevocably Consent that:

a. Your personal data, traffic data and communications data relating to Your use of the Services forming part of The Agreement, including any mobile telephony,  will be retained and processed in line with the applicable data protection and retention legislation and that We may disclose any of this:
(i) among the group companies forming part of the GO group;

(ii) Our sub-contractors or agents;

(iii) between Us and other third parties including  but not limited to other authorised electronic communications providers and operators, Content providers, market research operators, and credit agencies.  You acknowledge that such sharing of data may be necessary for the purpose of providing better value and services in particular on the electronic communications services or other services as might be provided by Us as well as for fraud prevention, debts and credit referencing and to protect Our legitimate interests and other electronic communications operators and third parties. We commit to preserve all Your rights as data subject at all times;

(iv) if required to do so by law or in the good faith belief that any such preservation or disclosure is reasonably necessary to comply with legal process, enforce the terms of The Agreement, respond to claims that any use of the Services violates the rights of third-parties, or otherwise to protect the rights, property or personal safety of Us, Our directors, employees, users and the general public.

b. Committing to both installing/retaining the (i) GO Talk Anytime fixed phone line service,(ii) GO television service subscription to Gold interactive or above, and (iii) GO internet 15Mbps service subscription or above at Residential (non-commercial) Premises, as indicated in The Agreement within 30 days from date of request of The Bundle.

c. Committing to a minimum period of 24 consecutive months (“Term”) from the date of the last of the following services to be installed (i) GO Talk Anytime fixed phone line service (ii) GO television service subscription to Gold interactive or above (iii) GO internet service subscription to 15Mbps or above (“Commencement Date”).

16. The Bundle charge of forty eight euros (€48) per month shall come into force from the date when the last of the services specified in Clause 2(a), 2(b) and 2(c) above would have been installed at the Registered Premises as indicated in The Agreement. For the avoidance of doubt, any applicable usage and/or add-on charge shall commence from the date of the installation of the particular service.  For the avoidance of doubt, in the event that (a) We inform You of the date of installation of the services and for any reason You do not allow us to proceed with the installation, or (b) We are unable, for technical and/or commercial reasons to proceed with the installation of any or all of the services, then this Agreement shall be rendered null and void, subject that in the event that any of the services would have already been installed and activated, all obligations shall remain in force in connection to that particular service.

17. The Bundle charge of  forty eight euros (€48) per month is  applicable when  The Bundle and  any applicable usage and/or add-on charges are paid by Direct Debit. In cases where You do not pay via Direct Debit, then You will be required to pay the charge of fifty  euros (€50) per month for The Bundle.

18. E-Billing is the default method for billing purposes of The Bundle.You are required to supply GO with a valid email address where notifications will be sent inter alia informing You that a bill has been issued and any other information.  It is your responsibility to inform Us of any change in Your email address.  Should You prefer to opt for a  printed bill sent by post to Your billing address, You will be charged an additional two euros (€2) per month.

19. GO provides a basic itemisation free of charge in the bill. Should a more detailed itemisation be required GO reserves the right to levy a processing fee.

20. Should any cheques, credit cards, direct debit mandates or standing orders be returned for insufficient funds or for any other reason, GO reserves the right to levy a penalty charge of five euro (€5) per each rejected payment. Furthermore, the Subscriber shall at all times remain responsible for any resulting banking or other charges.

21. Unless The Agreement is earlier terminated, on the expiry of the Term or any subsequent renewed Term, subject that The Bundle would still be commercially marketed at the time on the same Terms & Conditions, The Agreement may be automatically renewed for further twenty-four (24) month periods.  Should You not wish to renew The Bundle, You must notify Us in writing at least fifteen (15) days prior to expiry of the Term or any subsequent renewed Term. 

22. You acknowledge and agree that any free set-top boxes/ CAM/ modem You may be entitled to under The Bundle Terms and Conditions will only be issued whilst The Bundle is still being offered to the public. For the avoidance of doubt, You acknowledge and agree that any set-top box/ CAM/modem being offered in terms of The Bundle is being provided to You free of charge, but is and shall at all times remain Our property, and that the set-top box/ CAM/modem shall be returned to Us upon termination of The Bundle. In default, or should the equipment be returned damaged or faulty resulting from but not limited to misuse, mishandling, wilful damage, connection to unsuitable supply power, surges, lightening, tampering or service by unauthorised personnel, You will be liable to pay to Us the relative charges as stipulated in the Schedule of Charges. Such charge shall become immediately due and payable and is to be paid directly to Us.

23. Should The Bundle and/or any of the services as described in Clause 2 (a), (b) and (c) be terminated by either You, or Us for any reason attributable to You, prior to the lapse of the Initial Term, the following penalty charges, which for clarity are in addition to any other fees, dues, or charges howsoever defined in terms of The Agreement, shall become immediately due and payable:

a. A one-time Bundle Disconnection charge of one hundred euro(€100). For the avoidance of doubt this disconnection charge will be due and payable even if downgrading to any other Home Pack or other bundle.

b. A one-time charge of fifty euros (€50) representing the recovery of the lease of the GO Interactive HD box that has been provided to You by Us in terms of this or any other offer.

c. A one-time charge of sixty-four euros and ninety-nine cents (€64.99) representing the recovery of the lease of the GO DTTV set-top box/CAM that has been provided to You by Us in terms of this or any other offer.

Provided that in the event that the termination of The Bundle is rendered necessary due to a permanent move by You to any other Residential Premises wherein the GO television,  fixed phone line service, and internet service cannot be reached by Us, the one-time Bundle disconnection charge mentioned in Clause 23(a) above shall not be applicable. 

24. For the avoidance of doubt, in the event that The Bundle is terminated as per Clause 23 above or You opt not to renew The Bundle after the expiry of the Term, but choose to retain any of the services offered by Us, You agree that these services shall be charged at the standard rates applicable at the time and are remain governed by the applicable terms & conditions regulating the individual service concerned.

25. The Bundle is applicable only in those geographical areas where the television service, fixed phone line service, and internet service can be covered by Us.  Should one of the services not be available, We will inform You in writing of the options available and the respective charges associated therewith.  For clarity, unless You inform Us otherwise within thirty (30) days of Our notification, You hereby consent and agree to install the individual services that would be available in Your geographical area.

26. Once all services of The Bundle as indicated in Clause 2 have been activated, The Agreement, of which The Bundle Terms and Conditions constitute an integral part, shall supersede any and all previous agreement/s entered into by and between Us and Yourself in relation to GO fixed phone line and/or television and/or internet services. Subject that, in the event  The Bundle is terminated or otherwise expires, and in accordance with Clause 24 above, you retain any of the service/s offered by Us, then the individual agreements for the applicable services shall reapply as if they were never superseded in accordance with this Clause 24.  For clarity, in the event that in applying for The Bundle You were a new customer and no prior agreement existed with respect to any of the individual services, or that in the event that The Bundle is terminated or otherwise expires but whereas aforementioned You retain any of the individual services, then this Agreement shall remain in force with respect to such individual service and the relative terms and conditions regulating the service shall continue into force and unaffected by any termination or expiry of The Bundle.

27. For the avoidance of doubt, in the event that You choose to subscribe to any of the Home Pack add-on services which We may issue from time to time, to the extent applicable the respective Home Pack add-on service shall be governed by the applicable standard and/or special terms and conditions of the individual service, without, however, in any way diminishing the obligations assumed in terms of The Agreement.

28. We acknowledge that in the case of You subscribing to The Bundle through telesales You may terminate The Bundle in accordance with the provisions as laid down in the Distance Selling Regulations, without incurring any penalty charges.

29. We reserve the right to terminate this Agreement in the event of any deliberate abuse and/or misuse of the services subject matter of this Agreement, or if in default of payment.

30. We reserve the right to amend these terms and conditions at any time, provided that We shall give You a thirty (30) days’ written notice prior to such amendments taking effect. Should You not wish to accept the proposed amendments, You must, within thirty (30) days of having been so notified, inform Us of such non-acceptance. For the sake of clarity, such notification of non-acceptance on Your part shall be deemed to constitute a termination of The Agreement in terms of Clause of 23 above in which event, the penalty charges therein stipulated shall not become applicable. Failure on Your part to notify Us in writing within the stipulated time period of such non-acceptance will constitute an irrevocable acceptance of any such amendments for the duration of this Agreement.

31. This Agreement and all matters relating to it shall be governed, construed and take effect in accordance with the laws of Malta and the parties submit to the exclusive jurisdiction of the courts in Malta.

32. This Agreement has been drafted and negotiated in the English language and the English text shall be regarded as the authoritative text. If this Agreement is translated into any other language, any ambiguity or disagreement that may arise shall be resolved by reference to the English text.

Limitless Home Pack Gold

1. This Bundle Service Agreement (hereinafter referred to as “The Agreement”) is being entered into by GO p.l.c, (C22334), being the operator of the brand ‘GO’, duly authorized to act in representation of its subsidiary and affiliate companies members of the GO Group (hereinafter referred to as “We” / “Us”/ “Our”).  The Bundle (as specified in clause 2 below) is subject to the following terms and conditions (“The Bundle Service Terms and Conditions”), The Agreement entered into between Us and the Registered Residential Subscriber (hereinafter referred to as “You” / “Yourself” / “Your”) indicated therein for the provision of The Bundle, as well as the standard terms and conditions of each individual service making up The Bundle and any other applicable terms and conditions. In the event of any difference or conflict between The Bundle Service Terms and Conditions, the standard terms and conditions of each individual service making up The Bundle, and any other applicable terms and conditions, The Bundle Service Terms and Conditions shall prevail.

2. The Bundle entitles You to all of the following services at the rate of forty three euros (€43) per month:

a. GO Gold television service.

b. GO Talk Anytime fixed phone line service and GO Talk Anytime Limitless All Local Fixed add-on bundle.

c.  GO internet, 15Mbps, subject to the speed your line can attain.

d. Up to 400 free mobile minutes  on a monthly basis, given in up to four (4) individual free minute bundles of 100 minutes each, with one (1) bundle per individual member within the Home Pack mobile community (‘’Community”) in accordance with Clause 8 below.

3. The rate of forty three euros (€43) per month includes the access fee of one (1) television service as indicated in Clause 2(a) above. To activate GO Gold television service on other DTTV set-top boxes/CAMs within the Residential Premises, an additional monthly GO TV Network Access fee per set-top box /CAM as per Schedule of Charges applies.

4. If You are a new television customer, The Bundle entitles You to all of the following:

a. Free standard installation of the GO television service indicated in Clause 2(a) above on up to two set-top boxes/CAMS and antenna if requried. For the avoidance of doubt, the free GO television installation will be provided at the Residential Premises indicated in The Agreement.

b. Up to two (2)  Free GO DTTV set-top box/CAM  in accordance with Clause 5 below.   For the avoidance of doubt should you require additional DTTV set-top boxes/CAMs for additional tv outlets, the one-time charges for the set top box/es and/or CAM/s including installation per set top box/es and/or CAM/s shall apply as per rates stipulated in the Schedule of Charges.

5. If You are an existing GO television subscriber, and have already benefitted from a set-top box/CAM offer under a previous offer, You would be entitled to the free use of an additional set-top box/CAM when upgrading to The Bundle, and committing to all terms and conditions of The Bundle and provided that the total number of set- top boxes/CAMs provided for Your use as part of The Bundle or any other prior offer is not more than two (2) and subject that you commit for a further 24 consecutive month period. For the avoidance of doubt, it is being agreed that the set-top boxes/CAMs are being leased free of charge, and any equipment will remain property of GO.

6. If You are a new GO fixed phone line customer, The Bundle entitles You to free installation of the GO fixed phone line service indicated in Clause 2(b) above. For the avoidance of doubt, the free GO fixed phone line installation will be provided at the Residential Premises indicated in The Agreement.

7.  If You are a new GO internet customer, The Bundle entitles You to all of the following:

a. Free installation of the GO internet service as indicated in Clause 2 (c) above.  For the avoidance of doubt, the free GO internet installation will be provided at the Residential Premises indicated in The Agreement.  Additional charges may apply for the installation of other internet services as listed in the respective Schedule of Charges.

b. The free use of a GO standard modem for the internet service indicated in Clause 2(c) above.  For the avoidance of doubt, it is being agreed that the modem is being leased free of charge, and any equipment will remain property of GO.  Additional charges may apply for other types of customer premises equipement as listed in the respective Schedule of Charges.

8. For You to benefit from the free bundle of mobile minutes as per Clause 2(d) above, You need to activate Your Community as per Clause 11 below. You may also invite up to three (3) other GO mobile numbers, in addition to the GO mobile number, to form part of the Community. The four (4) Community members can be either subscribed to any Pay As You GO mobile tariff plan as per Clause 9 below or to any of the GO mobile Pay Monthly Plans compatible with Home Pack. The latter will hereinafter be referred to as “Pay Monthly”.   For the avoidance of any doubt, every member of the Community is entitled to a maximum of one hundred (100) free minutes per month and no transfer of minutes from one member to another is allowed. For the avoidance of doubt, in the event that the maximum of one hundred (100) free minutes per monthly bundle is consumed, and the GO mobile number forming part of Your Community in the given month is changed in accordance with these terms and conditions, then the new number forming part of Your Community will not be entitled to receive the free minute bundle prior to the lapse of the month in which the free minutes were consumed by the previous GO mobile number.

9. If You are a Pay As You GO mobile customer, Your tariff plan will change to the Pay As You GO Home Pack mobile tariff plan once Your request to activate the Community is successful. If any of the other GO mobile numbers You add to Your Community further to Clause 8 above, are also Pay As You GO mobile customers, their tariff plan will also change to the Pay As You GO Home Pack mobile tariff plan once they accept to join Your Community. In the event that a member of the Community no longer remains part of Your Community, their mobile tariff plan will automatically be migrated to GO’s Pay As You GO Base plan.  You assume all responsibility to inform members of Your Community of these conditions.

10.  A Community is a group of up to four (4) Pay As You GO and/or Pay Monthly GO mobile customers as per Clauses 8 and 9 above, who can benefit from free mobile minutes by joining a Community.  Your GO mobile number or the GO mobile number nominated by Yourself to activate the Community, will be able to invite three (3) other eligible GO mobile customers as indicated in Clause 8 above, to form part of the Community. The first three Community members are added free of charge.  Any changes thereafter cost one euro sixteen cents (€1.16) per number. Without prejudice to Your and/or Our right to suspend and/or terminate this Agreement, for the avoidance of doubt, it is hereby being expressly stated and agreed that only the registered GO mobile number nominated by Yourself to activate the Community will have the right for the day to day management of and for any information associated with the Community. To be eligible to join a Community, the GO mobile numbers:

a. Must be verified by GO as registered customers on the appropriate tariff plan;

b. Can only form part of one (1) Community at any given time.

11. Your Community is formed as follows:

a. You or The Pay As You GO or Pay Monthly number nominated by Yourself activates the Community by sending an SMS to 50700280, containing The Subscription Number and the GO Talk Anytime fixed phone line number forming part of The Bundle. The format of the SMS should be as follows: 2XXXXXXX PXXXXXXXXXX, where 2XXXXXXX indicates the GO Talk Anytime fixed phone line number and PXXXXXXXXXX indicates The Subscription number. The SMS is free of charge. The Subscription number can be found on page 1 of The Bundle Service Agreement.

b. You or the nominated Pay As You GO / Pay Monthly number can invite up to three (3) other Pay As You GO and/or Pay Monthly customers to the Community by sending an SMS to 50700281 containing the mobile number being requested to be added to the Community. The first three (3) SMSes are free of charge. As per Clause 10 above any changes to these numbers can be made, at any time, at the cost of one euro sixteen cents (€1.16) per SMS.

c. The Pay As You GO and/or Pay Monthly customers eligible to join the Community will become members of the Community only once they accept Your invitation by replying to the SMS sent from GO, and the Community will be considered to be full once three (3) Pay As You GO and/or Pay Monthly customers together with Your/the nominated Pay As You GO or Pay Monthly number have joined the Community.

12. Once the Community is set up, The Bundle will entitle You to:

a. up to four hundred (400) free mobile minutes given in individual bundles of one hundred (100) minutes each in accordance with  Clause 2 (d)  and Clause 8 above and which can be used as follows:

i. on calls between the four (4) GO mobile numbers within Your Community in accordance with Clause 11 above.

ii. on calls from the four (4) GO mobile numbers towards the GO Talk Anytime fixed phone line number forming part of The Bundle.

b. Your free mobile minute bundle, as per Clause 2(d) above will be assigned on the day of successful creation of Your Community. Invited Community members will be assigned their respective free mobile minute bundle upon successful registration to Your Community. In the case of Pay As You GO mobile customers each individual bundle will be assigned in full upon joining the Community and will then be renewed each month, on the same date when the first bundle has been assigned. For customers on Pay Monthly plans, their individual free mobile minute bundle will always be assigned on the 1st of every month except for the first bundle which will be assigned on a pro-rata basis on the date when they have successfully joined the Community.

c. Any unutilised free minutes are not carried forward if not consumed within the month.

d. The free minutes cannot be transferred through Credit Transfer.

e. The free -minutes are deducted on a per 30-second basis.

f. The maximum call duration is 60 minutes and calls shall be automatically terminated when the 60 minutes have elapsed.

g. Upon consumption of each individual free mobile minute bundle, intra-community calls to each individual Community member (including calls towards the GO Talk Anytime fixed phone line number) are to be charged at the applicable rates in accordance with the customers’ Tariff Plan.  It is Your responsibility to inform the Community members of these conditions.

h. Your or the nominated Pay As You GO / Pay Monthly number can send a blank SMS to 50700284 at a charge of  €0.05 to query the Community members.

i. Members of a Community can check whether a number is part of a Community by sending a SMS quoting the number to be checked to 50700284 at a cost of €0.05.

j. Members of a Community can check the remaining balance of minutes in their respective free bundle by sending a blank SMS to 50700285 at a charge of €0.05.

k. Calls from the GO Talk Anytime fixed phone line towards the registered applicable Community’s GO mobile numbers will be charged as per the Talk Anytime rates.

l. The free minutes assigned to each individual Community member, as per Clause 2(d), can be used when making calls from Malta in line with Clause 12 (a).  For the avoidance of doubt any other calls made whilst in Malta to numbers not members in Your Community will be charged at the local call rates applicable to the customer’s mobile tariff plan. The standard charges apply when calling from abroad.  For further information regarding roaming charges, please refer to Roaming section of the GO website (www.go.com.mt).

13. A Community member is deemed to be part of Your Community until:

a. The Community member sends a blank SMS to 50700282 (free of charge) at any time to withdraw from the Community.  In cases of Pay As You GO type of subscriptions, any Community members withdrawing from the Community will have their mobile tariff plan automatically migrated to GO’s Pay As You GO Base Plan.

b. Your or the nominated Pay As You GO/ Pay Monthly number excludes a member of the Community by sending a SMS to 50700283 (cost is €0.05) containing the mobile number being requested to be withdrawn from the Community.  In cases of Pay As You GO type of subscriptions, any Community members removed from the Community will have their mobile tariff plan automatically migrated to GO’s Pay As You GO Base Plan.

c. The Agreement is terminated or not renewed, for any reason and by any Party.

14. The free minutes entitlement in line with Clause 2(d) above will no longer be available if:

a. The Agreement is terminated or not renewed, for any reason and by any Party;

b. We suspend and/or disconnect any or all of the Services making up The Bundle for any reason attributable to You;

c. You or the nominated Pay As You GO / Pay Monthly number terminates the Community;

d. You or the nominated Pay As You GO / Pay Monthly number is no longer a GO subscriber for mobile services or migrates to any other Tariff Plan not compatible with The Agreement.

15. By entering into The Agreement with Us for the provision of The Bundle, You hereby irrevocably Consent that:

a. Your personal data, traffic data and communications data relating to Your use of the Services forming part of The Agreement, including any mobile telephony,  will be retained and processed in line with the applicable data protection and retention legislation and that We may disclose any of this:
(i) among the group companies forming part of the GO group;

(ii) Our sub-contractors or agents;

(iii) between Us and other third parties including  but not limited to other authorised electronic communications providers and operators, Content providers, market research operators, and credit agencies.  You acknowledge that such sharing of data may be necessary for the purpose of providing better value and services in particular on the electronic communications services or other services as might be provided by Us as well as for fraud prevention, debts and credit referencing and to protect Our legitimate interests and other electronic communications operators and third parties. We commit to preserve all Your rights as data subject at all times;

(iv) if required to do so by law or in the good faith belief that any such preservation or disclosure is reasonably necessary to comply with legal process, enforce the terms of The Agreement, respond to claims that any use of the Services violates the rights of third-parties, or otherwise to protect the rights, property or personal safety of Us, Our directors, employees, users and the general public.

b. Committing to both installing/retaining the (i) GO Talk Anytime fixed phone line service,(ii) GO television service subscription to Gold or above, and (iii) GO internet 15Mbps service subscription or above at Residential (non-commercial) Premises, as indicated in The Agreement within 30 days from date of request of The Bundle.

c. Committing to a minimum period of 24 consecutive months (“Term”) from the date of the last of the following services to be installed (i) GO Talk Anytime fixed phone line service (ii) GO television service subscription to Gold or above (iii) GO internet service subscription to 15Mbps or above (“Commencement Date”).

16. The Bundle charge of forty three euro (€43) per month shall come into force from the date when the last of the services specified in Clause 2(a), 2(b) and 2(c) above would have been installed at the Registered Premises as indicated in The Agreement. For the avoidance of doubt, any applicable usage and/or add-on charge shall commence from the date of the installation of the particular service.  For the avoidance of doubt, in the event that (a) We inform You of the date of installation of the services and for any reason You do not allow us to proceed with the installation, or (b) We are unable, for technical and/or commercial reasons to proceed with the installation of any or all of the services, then this Agreement shall be rendered null and void, subject that in the event that any of the services would have already been installed and activated, all obligations shall remain in force in connection to that particular service.

17. The Bundle charge of  forty three euros (€43) per month is  applicable when  The Bundle and  any applicable usage and/or add-on charges are paid by Direct Debit. In cases where You do not pay via Direct Debit, then You will be required to pay the charge of forty five euros (€45) per month for The Bundle.

18. E-Billing is the default method for billing purposes of The Bundle.You are required to supply GO with a valid email address where notifications will be sent inter alia informing You that a bill has been issued and any other information.  It is your responsibility to inform Us of any change in Your email address.  Should You prefer to opt for a  printed bill sent by post to Your billing address, You will be charged an additional two euros (€2) per month.

19. You are entitled to basic itemisation free of charge in the bill. Should a more detailed itemisation be requested by You, We reserve the right to levy a charge.

20. Should any cheques, credit cards, direct debit mandates or standing orders be returned for insufficient funds or for any other reason, GO reserves the right to levy a penalty charge of five euro (€5) per each rejected payment. Furthermore, the Subscriber shall at all times remain responsible for any resulting banking or other charges.

21. Unless The Agreement is earlier terminated, on the expiry of the Term or any subsequent renewed Term, subject that The Bundle would still be commercially marketed at the time on the same Terms & Conditions, The Agreement may be automatically renewed for further twenty-four (24) month periods.  Should You not wish to renew The Bundle, You must notify Us in writing at least fifteen (15) days prior to expiry of the Term or any subsequent renewed Term. 

22. You acknowledge and agree that any free set-top boxes/ CAM/ modem You may be entitled to under The Bundle Terms and Conditions will only be issued whilst The Bundle is still being offered to the public. For the avoidance of doubt, You acknowledge and agree that any set-top box/ CAM/modem being offered in terms of The Bundle is being provided to You free of charge, but is and shall at all times remain Our property, and that the set-top box/ CAM/modem shall be returned to Us upon termination of The Bundle. In default, or should the equipment be returned damaged or faulty resulting from but not limited to misuse, mishandling, wilful damage, connection to unsuitable supply power, surges, lightening, tampering or service by unauthorised personnel, You will be liable to pay to Us the relative charges as stipulated in the Schedule of Charges. Such charge shall become immediately due and payable and is to be paid directly to Us.

23. Should The Bundle and/or any of the services as described in Clause 2 (a), (b) and (c) be terminated by either You, or Us for any reason attributable to You, prior to the lapse of the Initial Term, the following penalty charges, which for clarity are in addition to any other fees, dues, or charges howsoever defined in terms of The Agreement, shall become immediately due and payable:

a. A one-time Bundle Disconnection charge of one hundred euro(€100). For the avoidance of doubt this disconnection charge will be due and payable even if downgrading to any other Home Pack or other bundle.

b. A one-time charge of sixty-four euros and ninety-nine cents (€64.99) representing the recovery of the lease of the GO DTTV set-top box/CAM that has been provided to You by Us in terms of this or any other offer.

Provided that in the event that the termination of The Bundle is rendered necessary due to a permanent move by You to any other Residential Premises wherein the GO television,  fixed phone line service, and internet service cannot be reached by Us, the one-time Bundle disconnection charge mentioned in Clause 23(a) above shall not be applicable. 

24. For the avoidance of doubt, in the event that The Bundle is terminated as per Clause 23 above or You opt not to renew The Bundle after the expiry of the Term, but choose to retain any of the services offered by Us, You agree that these services shall be charged at the standard rates applicable at the time and are remain governed by the applicable terms & conditions regulating the individual service concerned.

25. The Bundle is applicable only in those geographical areas where the television service, fixed phone line service, and internet service can be covered by Us.  Should one of the services not be available, We will inform You in writing of the options available and the respective charges associated therewith.  For clarity, unless You inform Us otherwise within thirty (30) days of Our notification, You hereby consent and agree to install the individual services that would be available in Your geographical area.

26. Once all services of The Bundle as indicated in Clause 2 have been activated, The Agreement, of which The Bundle Terms and Conditions constitute an integral part, shall supersede any and all previous agreement/s entered into by and between Us and Yourself in relation to GO fixed phone line and/or television and/or internet services. Subject that, in the event  The Bundle is terminated or otherwise expires, and in accordance with Clause 24 above, you retain any of the service/s offered by Us, then the individual agreements for the applicable services shall reapply as if they were never superseded in accordance with this Clause 24.  For clarity, in the event that in applying for The Bundle You were a new customer and no prior agreement existed with respect to any of the individual services, or that in the event that The Bundle is terminated or otherwise expires but whereas aforementioned You retain any of the individual services, then this Agreement shall remain in force with respect to such individual service and the relative terms and conditions regulating the service shall continue into force and unaffected by any termination or expiry of The Bundle.

27. For the avoidance of doubt, in the event that You choose to subscribe to any of the Home Pack add-on services which We may issue from time to time, to the extent applicable the respective Home Pack add-on service shall be governed by the applicable standard and/or special terms and conditions of the individual service, without, however, in any way diminishing the obligations assumed in terms of The Agreement.

28. We acknowledge that in the case of You subscribing to The Bundle through telesales You may terminate The Bundle in accordance with the provisions as laid down in the Distance Selling Regulations, without incurring any penalty charges.

29. We reserve the right to terminate this Agreement in the event of any deliberate abuse and/or misuse of the services subject matter of this Agreement, or if in default of payment.

30. We reserve the right to amend these terms and conditions at any time, provided that We shall give You a thirty (30) days’ written notice prior to such amendments taking effect. Should You not wish to accept the proposed amendments, You must, within thirty (30) days of having been so notified, inform Us of such non-acceptance. For the sake of clarity, such notification of non-acceptance on Your part shall be deemed to constitute a termination of The Agreement in terms of Clause of 23 above in which event, the penalty charges therein stipulated shall not become applicable. Failure on Your part to notify Us in writing within the stipulated time period of such non-acceptance will constitute an irrevocable acceptance of any such amendments for the duration of this Agreement.

31. This Agreement and all matters relating to it shall be governed, construed and take effect in accordance with the laws of Malta and the parties submit to the exclusive jurisdiction of the courts in Malta.

32. This Agreement has been drafted and negotiated in the English language and the English text shall be regarded as the authoritative text. If this Agreement is translated into any other language, any ambiguity or disagreement that may arise shall be resolved by reference to the English text.

Limitless Home Pack Silver Interactive

1. This Bundle Service Agreement (hereinafter referred to as “The Agreement”) is being entered into by GO p.l.c, (C22334), being the operator of the brand ‘GO’, duly authorized to act in representation of its subsidiary and affiliate companies members of the GO Group (hereinafter referred to as “We” / “Us”/ “Our”).  The Bundle (as specified in clause 2 below) is subject to the following terms and conditions (“The Bundle Service Terms and Conditions”), The Agreement entered into between Us and the Registered Residential Subscriber (hereinafter referred to as “You” / “Yourself” / “Your”) indicated therein for the provision of The Bundle, as well as the standard terms and conditions of each individual service making up The Bundle and any other applicable terms and conditions. In the event of any difference or conflict between The Bundle Service Terms and Conditions, the standard terms and conditions of each individual service making up The Bundle, and any other applicable terms and conditions, The Bundle Service Terms and Conditions shall prevail.

2. The Bundle entitles You to all of the following services at the rate of thirty eight euros (€38) per month:

a. GO Silver Interactive television service.

b. GO Talk Anytime fixed phone line service.

c.  GO internet, 15Mbps, subject to the speed your line can attain.

d. Up to 400 free mobile minutes  on a monthly basis, given in up to four (4) individual free minute bundles of 100 minutes each, with one (1) bundle per individual member within the Home Pack mobile community (‘’Community”) in accordance with Clause 8 below.

3. The rate of thirty eight euros (€38) per month includes the access fee of one (1) television service as indicated in Clause 2(a) above. To activate GO Interactive television service on other set-top boxes within the Residential Premises, an extra monthly GO Interactive TV additional outlet fee per set-top box as per Schedule of Charges applies.

4. If You are a new television customer, The Bundle entitles You to all of the following:

a. Two (2) Free GO Interactive TV HD boxes, in accordance with Clause 5 below.   For the avoidance of doubt should you require additional set-top boxes for additional tv outlets, the one-time charges for the set top box/es including installation shall apply as per rates stipulated in the Schedule of Charges.

b. Free standard installation of the GO Interactive television service indicated in Clause 2(a) above. For the avoidance of doubt, the free GO television installation will be provided at the Residential Premises indicated in The Agreement and on one (1) GO Interactive HD TV box. Should You be benefiting from the second free GO Interactive HD TV box, one (1) self-installation kit will be provided to You free of charge for You to install the second free GO Interactive HD TV box.

5.  If You are an existing GO television subscriber, and have already benefitted from a set-top box/CAM offer under a previous offer/s, You would be entitled to the free use of up to two (2) GO Interactive TV HD box/es upon the return of up to two (2) free DTTV set-top box/CAMs when upgrading to The Bundle, and committing to all terms and conditions of The Bundle.

6. If You are a new GO fixed phone line customer, The Bundle entitles You to free installation of the GO fixed phone line service indicated in Clause 2(b) above. For the avoidance of doubt, the free GO fixed phone line installation will be provided at the Residential Premises indicated in The Agreement.

7.  If You are a new GO internet customer, The Bundle entitles You to all of the following:

a. Free installation of the GO internet service as indicated in Clause 2 (c) above.  For the avoidance of doubt, the free GO internet installation will be provided at the Residential Premises indicated in The Agreement.  Additional charges may apply for the installation of other internet services as listed in the respective Schedule of Charges.

b. The free use of a GO standard modem for the internet service indicated in Clause 2(c) above.  For the avoidance of doubt, it is being agreed that the modem is being leased free of charge, and any equipment will remain property of GO.  Additional charges may apply for other types of customer premises equipement as listed in the respective Schedule of Charges.

8. For You to benefit from the free bundle of mobile minutes as per Clause 2(d) above, You need to activate Your Community as per Clause 11 below. You may also invite up to three (3) other GO mobile numbers, in addition to the GO mobile number, to form part of the Community. The four (4) Community members can be either subscribed to any Pay As You GO mobile tariff plan as per Clause 9 below or to any of the GO mobile Pay Monthly Plans compatible with Home Pack. The latter will hereinafter be referred to as “Pay Monthly”.   For the avoidance of any doubt, every member of the Community is entitled to a maximum of one hundred (100) free minutes per month and no transfer of minutes from one member to another is allowed. For the avoidance of doubt, in the event that the maximum of one hundred (100) free minutes per monthly bundle is consumed, and the GO mobile number forming part of Your Community in the given month is changed in accordance with these terms and conditions, then the new number forming part of Your Community will not be entitled to receive the free minute bundle prior to the lapse of the month in which the free minutes were consumed by the previous GO mobile number.

9. If You are a Pay As You GO mobile customer, Your tariff plan will change to the Pay As You GO Home Pack mobile tariff plan once Your request to activate the Community is successful. If any of the other GO mobile numbers You add to Your Community further to Clause 8 above, are also Pay As You GO mobile customers, their tariff plan will also change to the Pay As You GO Home Pack mobile tariff plan once they accept to join Your Community. In the event that a member of the Community no longer remains part of Your Community, their mobile tariff plan will automatically be migrated to GO’s Pay As You GO Base plan.  You assume all responsibility to inform members of Your Community of these conditions.

Your or the nominated Pay As You GO/ Pay Monthly number excludes a member of the Community by sending a SMS to 50700283 (cost is €0.05) containing the mobile number being requested to be withdrawn from the Community.  In cases of Pay As You GO type of subscriptions, any Community members removed from the Community will have their mobile tariff plan automatically migrated to GO’s Pay As You GO Base Plan.

c. The Agreement is terminated or not renewed, for any reason and by any Party.

14. The free minutes entitlement in line with Clause 2(d) above will no longer be available if:

a. The Agreement is terminated or not renewed, for any reason and by any Party;

b. We suspend and/or disconnect any or all of the Services making up The Bundle for any reason attributable to You;

c. You or the nominated Pay As You GO / Pay Monthly number terminates the Community;

d. You or the nominated Pay As You GO / Pay Monthly number is no longer a GO subscriber for mobile services or migrates to any other Tariff Plan not compatible with The Agreement.

15. By entering into The Agreement with Us for the provision of The Bundle, You hereby irrevocably Consent that:

a. Your personal data, traffic data and communications data relating to Your use of the Services forming part of The Agreement, including any mobile telephony,  will be retained and processed in line with the applicable data protection and retention legislation and that We may disclose any of this:
(i) among the group companies forming part of the GO group;

(ii) Our sub-contractors or agents;

(iii) between Us and other third parties including  but not limited to other authorised electronic communications providers and operators, Content providers, market research operators, and credit agencies.  You acknowledge that such sharing of data may be necessary for the purpose of providing better value and services in particular on the electronic communications services or other services as might be provided by Us as well as for fraud prevention, debts and credit referencing and to protect Our legitimate interests and other electronic communications operators and third parties. We commit to preserve all Your rights as data subject at all times;

(iv) if required to do so by law or in the good faith belief that any such preservation or disclosure is reasonably necessary to comply with legal process, enforce the terms of The Agreement, respond to claims that any use of the Services violates the rights of third-parties, or otherwise to protect the rights, property or personal safety of Us, Our directors, employees, users and the general public.

b. Committing to both installing/retaining the (i) GO Talk Anytime fixed phone line service,(ii) GO television service subscription to Silver interactive or above, and (iii) GO internet 15Mbps service subscription or above at Residential (non-commercial) Premises, as indicated in The Agreement within 30 days from date of request of The Bundle.

c. Committing to a minimum period of 24 consecutive months (“Term”) from the date of the last of the following services to be installed (i) GO Talk Anytime fixed phone line service (ii) GO television service subscription to Silver interactive or above (iii) GO internet service subscription to 15Mbps or above (“Commencement Date”).

16. The Bundle charge of thirty eight euros (€38) per month shall come into force from the date when the last of the services specified in Clause 2(a), 2(b) and 2(c) above would have been installed at the Registered Premises as indicated in The Agreement. For the avoidance of doubt, any applicable usage and/or add-on charge shall commence from the date of the installation of the particular service.  For the avoidance of doubt, in the event that (a) We inform You of the date of installation of the services and for any reason You do not allow us to proceed with the installation, or (b) We are unable, for technical and/or commercial reasons to proceed with the installation of any or all of the services, then this Agreement shall be rendered null and void, subject that in the event that any of the services would have already been installed and activated, all obligations shall remain in force in connection to that particular service.

17. The Bundle charge of  thirty eight euros (€38) per month is  applicable when  The Bundle and  any applicable usage and/or add-on charges are paid by Direct Debit. In cases where You do not pay via Direct Debit, then You will be required to pay the charge of forty euros (€40) per month for The Bundle.

18. E-Billing is the default method for billing purposes of The Bundle.You are required to supply GO with a valid email address where notifications will be sent inter alia informing You that a bill has been issued and any other information.  It is your responsibility to inform Us of any change in Your email address.  Should You prefer to opt for a  printed bill sent by post to Your billing address, You will be charged an additional two euro (€2) per month.

19. GO provides a basic itemisation free of charge in the bill. Should a more detailed itemisation be required GO reserves the right to levy a processing fee.

20. Should any cheques, credit cards, direct debit mandates or standing orders be returned for insufficient funds or for any other reason, GO reserves the right to levy a penalty charge of five euro (€5) per each rejected payment. Furthermore, the Subscriber shall at all times remain responsible for any resulting banking or other charges.

21. Unless The Agreement is earlier terminated, on the expiry of the Term or any subsequent renewed Term, subject that The Bundle would still be commercially marketed at the time on the same Terms & Conditions, The Agreement may be automatically renewed for further twenty-four (24) month periods.  Should You not wish to renew The Bundle, You must notify Us in writing at least fifteen (15) days prior to expiry of the Term or any subsequent renewed Term. 

22. You acknowledge and agree that any free set-top boxes/ CAM/ modem You may be entitled to under The Bundle Terms and Conditions will only be issued whilst The Bundle is still being offered to the public. For the avoidance of doubt, You acknowledge and agree that any set-top box/ CAM/modem being offered in terms of The Bundle is being provided to You free of charge, but is and shall at all times remain Our property, and that the set-top box/ CAM/modem shall be returned to Us upon termination of The Bundle. In default, or should the equipment be returned damaged or faulty resulting from but not limited to misuse, mishandling, wilful damage, connection to unsuitable supply power, surges, lightening, tampering or service by unauthorised personnel, You will be liable to pay to Us the relative charges as stipulated in the Schedule of Charges. Such charge shall become immediately due and payable and is to be paid directly to Us.

23. Should The Bundle and/or any of the services as described in Clause 2 (a), (b) and (c) be terminated by either You, or Us for any reason attributable to You, prior to the lapse of the Initial Term, the following penalty charges, which for clarity are in addition to any other fees, dues, or charges howsoever defined in terms of The Agreement, shall become immediately due and payable:

a. A one-time Bundle Disconnection charge of one hundred euro(€100). For the avoidance of doubt this disconnection charge will be due and payable even if downgrading to any other Home Pack or other bundle.

b. A one-time charge of fifty euros (€50) representing the recovery of the lease of the GO Interactive HD box that has been provided to You by Us in terms of this or any other offer.

c. A one-time charge of sixty-four euros and ninety-nine cents (€64.99) representing the recovery of the lease of the GO DTTV set-top box/CAM that has been provided to You by Us in terms of this or any other offer.

Provided that in the event that the termination of The Bundle is rendered necessary due to a permanent move by You to any other Residential Premises wherein the GO television,  fixed phone line service, and internet service cannot be reached by Us, the one-time Bundle disconnection charge mentioned in Clause 23(a) above shall not be applicable. 

24. For the avoidance of doubt, in the event that The Bundle is terminated as per Clause 23 above or You opt not to renew The Bundle after the expiry of the Term, but choose to retain any of the services offered by Us, You agree that these services shall be charged at the standard rates applicable at the time and are remain governed by the applicable terms & conditions regulating the individual service concerned.

25. The Bundle is applicable only in those geographical areas where the television service, fixed phone line service, and internet service can be covered by Us.  Should one of the services not be available, We will inform You in writing of the options available and the respective charges associated therewith.  For clarity, unless You inform Us otherwise within thirty (30) days of Our notification, You hereby consent and agree to install the individual services that would be available in Your geographical area.

26. Once all services of The Bundle as indicated in Clause 2 have been activated, The Agreement, of which The Bundle Terms and Conditions constitute an integral part, shall supersede any and all previous agreement/s entered into by and between Us and Yourself in relation to GO fixed phone line and/or television and/or internet services. Subject that, in the event  The Bundle is terminated or otherwise expires, and in accordance with Clause 24 above, you retain any of the service/s offered by Us, then the individual agreements for the applicable services shall reapply as if they were never superseded in accordance with this Clause 24.  For clarity, in the event that in applying for The Bundle You were a new customer and no prior agreement existed with respect to any of the individual services, or that in the event that The Bundle is terminated or otherwise expires but whereas aforementioned You retain any of the individual services, then this Agreement shall remain in force with respect to such individual service and the relative terms and conditions regulating the service shall continue into force and unaffected by any termination or expiry of The Bundle.

27. For the avoidance of doubt, in the event that You choose to subscribe to any of the Home Pack add-on services which We may issue from time to time, to the extent applicable the respective Home Pack add-on service shall be governed by the applicable standard and/or special terms and conditions of the individual service, without, however, in any way diminishing the obligations assumed in terms of The Agreement.

28. We acknowledge that in the case of You subscribing to The Bundle through telesales You may terminate The Bundle in accordance with the provisions as laid down in the Distance Selling Regulations, without incurring any penalty charges.

29. We reserve the right to terminate this Agreement in the event of any deliberate abuse and/or misuse of the services subject matter of this Agreement, or if in default of payment.

30. We reserve the right to amend these terms and conditions at any time, provided that We shall give You a thirty (30) days’ written notice prior to such amendments taking effect. Should You not wish to accept the proposed amendments, You must, within thirty (30) days of having been so notified, inform Us of such non-acceptance. For the sake of clarity, such notification of non-acceptance on Your part shall be deemed to constitute a termination of The Agreement in terms of Clause of 23 above in which event, the penalty charges therein stipulated shall not become applicable. Failure on Your part to notify Us in writing within the stipulated time period of such non-acceptance will constitute an irrevocable acceptance of any such amendments for the duration of this Agreement.

31. This Agreement and all matters relating to it shall be governed, construed and take effect in accordance with the laws of Malta and the parties submit to the exclusive jurisdiction of the courts in Malta.

32. This Agreement has been drafted and negotiated in the English language and the English text shall be regarded as the authoritative text. If this Agreement is translated into any other language, any ambiguity or disagreement that may arise shall be resolved by reference to the English text.

Limitless Home Pack Silver

1. This Bundle Service Agreement (hereinafter referred to as “The Agreement”) is being entered into by GO p.l.c, (C22334), being the operator of the brand ‘GO’, duly authorized to act in representation of its subsidiary and affiliate companies members of the GO Group (hereinafter referred to as “We” / “Us”/ “Our”).  The Bundle (as specified in clause 2 below) is subject to the following terms and conditions (“The Bundle Service Terms and Conditions”), The Agreement entered into between Us and the Registered Residential Subscriber (hereinafter referred to as “You” / “Yourself” / “Your”) indicated therein for the provision of The Bundle, as well as the standard terms and conditions of each individual service making up The Bundle and any other applicable terms and conditions. In the event of any difference or conflict between The Bundle Service Terms and Conditions, the standard terms and conditions of each individual service making up The Bundle, and any other applicable terms and conditions, The Bundle Service Terms and Conditions shall prevail.

2. The Bundle entitles You to all of the following services at the rate of thirty three euros (€33) per month:
a. GO Silver television service.
b. GO Talk Anytime fixed phone line service.
c. GO internet, 15Mbps, subject to the speed your line can attain.
d. Up to 400 free mobile minutes  on a monthly basis, given in up to four (4) individual free minute bundles of 100 minutes each, with one (1) bundle per individual member within the Home Pack mobile community (‘’Community”) in accordance with Clause 8 below.

3. The rate of thirty three euros (€33) per month includes the access fee of one (1) television service as indicated in Clause 2(a) above. To activate GO Silver television service on other DTTV set-top boxes/CAMs within the Residential Premises, an additional monthly GO TV Network Access fee per set-top box /CAM as per Schedule of Charges applies.

4. If You are a new television customer, The Bundle entitles You to all of the following:
a. Free standard installation of the GO television service indicated in Clause 2(a) above on up to two set-top boxes/CAMS and antenna if requried. For the avoidance of doubt, the free GO television installation will be provided at the Residential Premises indicated in The Agreement.
b. Up to two (2)  Free GO DTTV set-top box/CAM  in accordance with Clause 5 below.   For the avoidance of doubt should you require additional DTTV set-top boxes/CAMs for additional tv outlets, the one-time charges for the set top box/es and/or CAM/s including installation per set top box/es and/or CAM/s shall apply as per rates stipulated in the Schedule of Charges.

5. If You are an existing GO television subscriber, and have already benefitted from a set-top box/CAM offer under a previous offer, You would be entitled to the free use of an additional set-top box/CAM when upgrading to The Bundle, and committing to all terms and conditions of The Bundle and provided that the total number of set- top boxes/CAMs provided for Your use as part of The Bundle or any other prior offer is not more than two (2) and subject that you commit for a further 24 consecutive month period. For the avoidance of doubt, it is being agreed that the set-top boxes/CAMs are being leased free of charge, and any equipment will remain property of GO.

6. If You are a new GO fixed phone line customer, The Bundle entitles You to free installation of the GO fixed phone line service indicated in Clause 2(b) above. For the avoidance of doubt, the free GO fixed phone line installation will be provided at the Residential Premises indicated in The Agreement.

7. If You are a new GO internet customer, The Bundle entitles You to all of the following:
a. Free installation of the GO internet service as indicated in Clause 2 (c) above.  For the avoidance of doubt, the free GO internet installation will be provided at the Residential Premises indicated in The Agreement.  Additional charges may apply for the installation of other internet services as listed in the respective Schedule of Charges.
b. The free use of a GO standard modem for the internet service indicated in Clause 2(c) above.  For the avoidance of doubt, it is being agreed that the modem is being leased free of charge, and any equipment will remain property of GO.  Additional charges may apply for other types of customer premises equipment as listed in the respective Schedule of Charges.

8. For You to benefit from the free bundle of mobile minutes as per Clause 2(d) above, You need to activate Your Community as per Clause 11 below. You may also invite up to three (3) other GO mobile numbers, in addition to the GO mobile number, to form part of the Community. The four (4) Community members can be either subscribed to any Pay As You GO mobile tariff plan as per Clause 9 below or to any of the GO mobile Pay Monthly Plans compatible with Home Pack. The latter will hereinafter be referred to as “Pay Monthly”.   For the avoidance of any doubt, every member of the Community is entitled to a maximum of one hundred (100) free minutes per month and no transfer of minutes from one member to another is allowed. For the avoidance of doubt, in the event that the maximum of one hundred (100) free minutes per monthly bundle is consumed, and the GO mobile number forming part of Your Community in the given month is changed in accordance with these terms and conditions, then the new number forming part of Your Community will not be entitled to receive the free minute bundle prior to the lapse of the month in which the free minutes were consumed by the previous GO mobile number.

9. If You are a Pay As You GO mobile customer, Your tariff plan will change to the Pay As You GO Home Pack mobile tariff plan once Your request to activate the Community is successful. If any of the other GO mobile numbers You add to Your Community further to Clause 8 above, are also Pay As You GO mobile customers, their tariff plan will also change to the Pay As You GO Home Pack mobile tariff plan once they accept to join Your Community. In the event that a member of the Community no longer remains part of Your Community, their mobile tariff plan will automatically be migrated to GO’s Pay As You GO Base plan.  You assume all responsibility to inform members of Your Community of these conditions.

10. A Community is a group of up to four (4) Pay As You GO and/or Pay Monthly GO mobile customers as per Clauses 8 and 9 above, who can benefit from free mobile minutes by joining a Community.  Your GO mobile number or the GO mobile number nominated by Yourself to activate the Community, will be able to invite three (3) other eligible GO mobile customers as indicated in Clause 8 above, to form part of the Community. The first three Community members are added free of charge.  Any changes thereafter cost one euro sixteen cents (€1.16) per number. Without prejudice to Your and/or Our right to suspend and/or terminate this Agreement, for the avoidance of doubt, it is hereby being expressly stated and agreed that only the registered GO mobile number nominated by Yourself to activate the Community will have the right for the day to day management of and for any information associated with the Community. To be eligible to join a Community, the GO mobile numbers:
a. Must be verified by GO as registered customers on the appropriate tariff plan;
b. Can only form part of one (1) Community at any given time.

11. Your Community is formed as follows:
a. You or The Pay As You GO or Pay Monthly number nominated by Yourself activates the Community by sending an SMS to 50700280, containing The Subscription Number and the GO Talk Anytime fixed phone line number forming part of The Bundle. The format of the SMS should be as follows: 2XXXXXXX PXXXXXXXXXX, where 2XXXXXXX indicates the GO Talk Anytime fixed phone line number and PXXXXXXXXXX indicates The Subscription number. The SMS is free of charge. The Subscription number can be found on page 1 of The Bundle Service Agreement.
b. You or the nominated Pay As You GO / Pay Monthly number can invite up to three (3) other Pay As You GO and/or Pay Monthly customers to the Community by sending an SMS to 50700281 containing the mobile number being requested to be added to the Community. The first three (3) SMSes are free of charge. As per Clause 10 above any changes to these numbers can be made, at any time, at the cost of one euro sixteen cents (€1.16) per SMS.
c. The Pay As You GO and/or Pay Monthly customers eligible to join the Community will become members of the Community only once they accept Your invitation by replying to the SMS sent from GO, and the Community will be considered to be full once three (3) Pay As You GO and/or Pay Monthly customers together with Your/the nominated Pay As You GO or Pay Monthly number have joined the Community.

12. Once the Community is set up, The Bundle will entitle You to:
a. up to four hundred (400) free mobile minutes given in individual bundles of one hundred (100) minutes each in accordance with  Clause 2 (d)  and Clause 8 above and which can be used as follows:
i. on calls between the four (4) GO mobile numbers within Your Community in accordance with Clause 11 above.
ii. on calls from the four (4) GO mobile numbers towards the GO Talk Anytime fixed phone line number forming part of The Bundle.
b. Your free mobile minute bundle, as per Clause 2(d) above will be assigned on the day of successful creation of Your Community. Invited Community members will be assigned their respective free mobile minute bundle upon successful registration to Your Community. In the case of Pay As You GO mobile customers each individual bundle will be assigned in full upon joining the Community and will then be renewed each month, on the same date when the first bundle has been assigned. For customers on Pay Monthly plans, their individual free mobile minute bundle will always be assigned on the 1st of every month except for the first bundle which will be assigned on a pro-rata basis on the date when they have successfully joined the Community.
c. Any unutilised free minutes are not carried forward if not consumed within the month.
d. The free minutes cannot be transferred through Credit Transfer.
e. The free -minutes are deducted on a per 30-second basis.
f. The maximum call duration is 60 minutes and calls shall be automatically terminated when the 60 minutes have elapsed.
g. Upon consumption of each individual free mobile minute bundle, intra-community calls to each individual Community member (including calls towards the GO Talk Anytime fixed phone line number) are to be charged at the applicable rates in accordance with the customers’ Tariff Plan.  It is Your responsibility to inform the Community members of these conditions.
h. Your or the nominated Pay As You GO / Pay Monthly number can send a blank SMS to 50700284 at a charge of  €0.05 to query the Community members.
i. Members of a Community can check whether a number is part of a Community by sending a SMS quoting the number to be checked to 50700284 at a cost of €0.05.
j. Members of a Community can check the remaining balance of minutes in their respective free bundle by sending a blank SMS to 50700285 at a charge of €0.05.
k. Calls from the GO Talk Anytime fixed phone line towards the registered applicable Community’s GO mobile numbers will be charged as per the Talk Anytime rates.
l. The free minutes assigned to each individual Community member, as per Clause 2(d), can be used when making calls from Malta in line with Clause 12 (a).  For the avoidance of doubt any other calls made whilst in Malta to numbers not members in Your Community will be charged at the local call rates applicable to the customer’s mobile tariff plan. The standard charges apply when calling from abroad.  For further information regarding roaming charges, please refer to Roaming section of the GO website (www.go.com.mt).

13. A Community member is deemed to be part of Your Community until:
a. The Community member sends a blank SMS to 50700282 (free of charge) at any time to withdraw from the Community.  In cases of Pay As You GO type of subscriptions, any Community members withdrawing from the Community will have their mobile tariff plan automatically migrated to GO’s Pay As You GO Base Plan.
b. Your or the nominated Pay As You GO/ Pay Monthly number excludes a member of the Community by sending a SMS to 50700283 (cost is €0.05) containing the mobile number being requested to be withdrawn from the Community.  In cases of Pay As You GO type of subscriptions, any Community members removed from the Community will have their mobile tariff plan automatically migrated to GO’s Pay As You GO Base Plan.
c. The Agreement is terminated or not renewed, for any reason and by any Party.

14. The free minutes entitlement in line with Clause 2(d) above will no longer be available if:
a. The Agreement is terminated or not renewed, for any reason and by any Party;
b. We suspend and/or disconnect any or all of the Services making up The Bundle for any reason attributable to You;
c. You or the nominated Pay As You GO / Pay Monthly number terminates the Community;
d. You or the nominated Pay As You GO / Pay Monthly number is no longer a GO subscriber for mobile services or migrates to any other Tariff Plan not compatible with The Agreement.

b. Committing to both installing/retaining the (i) GO Talk Anytime fixed phone line service,(ii) GO television service subscription to Silver or above, and (iii) GO internet 15Mbps service subscription or above at Residential (non-commercial) Premises, as indicated in The Agreement within 30 days from date of request of The Bundle.
c. Committing to a minimum period of 24 consecutive months (“Term”) from the date of the last of the following services to be installed (i) GO Talk Anytime fixed phone line service (ii) GO television service subscription to Silver or above (iii) GO internet service subscription to 15Mbps or above (“Commencement Date”).

17. The Bundle charge of thirty three euros (€33) per month is applicable when The Bundle and any applicable usage and/or add-on charges are paid by Direct Debit. In cases where You do not pay via Direct Debit, then You will be required to pay the charge of thirty five euros (€35) per month for The Bundle.

19. You are entitled to basic itemisation free of charge in the bill. Should a more detailed itemisation be requested by You, We reserve the right to levy a charge.

For the avoidance of doubt, You acknowledge and agree that any set-top box/ CAM/modem being offered in terms of The Bundle is being provided to You free of charge, but is and shall at all times remain Our property, and that the set-top box/ CAM/modem shall be returned to Us upon termination of The Bundle. In default, or should the equipment be returned damaged or faulty resulting from but not limited to misuse, mishandling, wilful damage, connection to unsuitable supply power, surges, lightening, tampering or service by unauthorised personnel, You will be liable to pay to Us the relative charges as stipulated in the Schedule of Charges. Such charge shall become immediately due and payable and is to be paid directly to Us.

23. Should The Bundle and/or any of the services as described in Clause 2 (a), (b) and (c) be terminated by either You, or Us for any reason attributable to You, prior to the lapse of the Initial Term, the following penalty charges, which for clarity are in addition to any other fees, dues, or charges howsoever defined in terms of The Agreement, shall become immediately due and payable:
a. A one-time Bundle Disconnection charge of one hundred euros (€100). For the avoidance of doubt this disconnection charge will be due and payable even if downgrading to any other Home Pack or other bundle.
b. A one-time charge of sixty-four euros and ninety-nine cents (€64.99) representing the recovery of the lease of the GO DTTV set-top box/CAM that has been provided to You by Us in terms of this or any other offer.
Provided that in the event that the termination of The Bundle is rendered necessary due to a permanent move by You to any other Residential Premises wherein the GO television,  fixed phone line service, and internet service cannot be reached by Us, the one-time Bundle disconnection charge mentioned in Clause 23(a) above shall not be applicable. 

24. For the avoidance of doubt, in the event that The Bundle is terminated as per Clause 23 above or You opt not to renew The Bundle after the expiry of the Term, but choose to retain any of the services offered by Us, You agree that these services shall be charged at the standard rates applicable at the time and are remain governed by the applicable terms & conditions regulating the individual service concerned.

25. The Bundle is applicable only in those geographical areas where the television service, fixed phone line service, and internet service can be covered by Us.  Should one of the services not be available, We will inform You in writing of the options available and the respective charges associated therewith.  For clarity, unless You inform Us otherwise within thirty (30) days of Our notification, You hereby consent and agree to install the individual services that would be available in Your geographical area.

26. Once all services of The Bundle as indicated in Clause 2 have been activated, The Agreement, of which The Bundle Terms and Conditions constitute an integral part, shall supersede any and all previous agreement/s entered into by and between Us and Yourself in relation to GO fixed phone line and/or television and/or internet services. Subject that, in the event The Bundle is terminated or otherwise expires, and in accordance with Clause 24 above, you retain any of the service/s offered by Us, then the individual agreements for the applicable services shall reapply as if they were never superseded in accordance with this Clause 24.  For clarity, in the event that in applying for The Bundle You were a new customer and no prior agreement existed with respect to any of the individual services, or that in the event that The Bundle is terminated or otherwise expires but whereas aforementioned You retain any of the individual services, then this Agreement shall remain in force with respect to such individual service and the relative terms and conditions regulating the service shall continue into force and unaffected by any termination or expiry of The Bundle.

27. For the avoidance of doubt, in the event that You choose to subscribe to any of the Home Pack add-on services which We may issue from time to time, to the extent applicable the respective Home Pack add-on service shall be governed by the applicable standard and/or special terms and conditions of the individual service, without, however, in any way diminishing the obligations assumed in terms of The Agreement.

28. We acknowledge that in the case of You subscribing to The Bundle through telesales You may terminate The Bundle in accordance with the provisions as laid down in the Distance Selling Regulations, without incurring any penalty charges.

29. We reserve the right to terminate this Agreement in the event of any deliberate abuse and/or misuse of the services subject matter of this Agreement, or if in default of payment.

30. We reserve the right to amend these terms and conditions at any time, provided that We shall give You a thirty (30) days’ written notice prior to such amendments taking effect. Should You not wish to accept the proposed amendments, You must, within thirty (30) days of having been so notified, inform Us of such non-acceptance. For the sake of clarity, such notification of non-acceptance on Your part shall be deemed to constitute a termination of The Agreement in terms of Clause of 23 above in which event, the penalty charges therein stipulated shall not become applicable. Failure on Your part to notify Us in writing within the stipulated time period of such non-acceptance will constitute an irrevocable acceptance of any such amendments for the duration of this Agreement.

31. This Agreement and all matters relating to it shall be governed, construed and take effect in accordance with the laws of Malta and the parties submit to the exclusive jurisdiction of the courts in Malta.

32. This Agreement has been drafted and negotiated in the English language and the English text shall be regarded as the authoritative text. If this Agreement is translated into any other language, any ambiguity or disagreement that may arise shall be resolved by reference to the English.
